I am writing in follow up to a request by J. Jones for the minutes of all meetings of the Gender Recognition Panel User Group held after 30 April 2013.

The request for minutes was refused under section 32(1)(c) of FOIA - " information is exempt if it is a document created by a member of the administrative staff of a court for the purposes of
proceedings in a particular cause or matter. "
I do not think it was correct to apply this exemption. Section 32 covers information held ‘only by virtue’ of being held for the purposes of court, inquiry or arbitration proceedings. The ICO in its guidance on 32(1)(c) lists the kinds of documents covered such as notebooks of judges, notices of hearings and correspondence which relate to particular proceedings.
The minutes of the user group are not covered by 32(1)(c.) as they were not created for the purposes of proceedings in a particular cause or matter.
This is clear since a previous request for minutes of this group was granted.
Please release this information without further delay
