Dear Airedale NHS Foundation Trust,

What documentation is provided to be completed by service users who begin, are undergoing, or have completed (including having been assigned a new NHS number) gender reassignment in order to change their details held by the trust?

What systems are in place in relation to handling patient records, both electronic and hard copy, for service users held in a previous and current identity? Including alert systems, quarantining, linking of records, data security, data accuracy, etc.

What systems and policies are in place in relation to services users, new and existing, who refuse to disclose their previous medical history in relation to previous identities and gender reassignment?

What systems and policies are in place regarding service users who obtain a gender recognition certificate?

What systems, reviews and oversights are in place to ensure the trust is reviewing and updating its policies and practices in relation to service users who are or have undergone gender reassignment, those who obtain a gender recognition certificate, and for complying with changes in legal requirements and regulations in relation to gender reassignment?

Thank you for your request for information from Airedale NHS Foundation
Trust which was received on 10^th February 2020 .  Your request has been
given the Reference Number ANHSFT REF 4745 . 

 

We will now proceed to process the request.  The deadline date for issuing
you with a full response is  9^th March 2020.   We will try to respond to
you before this date and we will contact you if we envisage delays or if
we need more information from you.

 

Please note that under the Freedom of Information Act, some information
can be subject to exemptions, which means that the Trust does not have to
provide the information requested.  Some exemptions are “absolute” such as
personal information and some only apply where the “public interest” in
maintaining the exemption, outweighs that of providing the information.

 

In some cases, where identifying, retrieving and processing the requested
information requires more time than the “appropriate cost limit” of two
and half days work, we may refuse the request or we can charge a fee.  If
the latter is the case, I will let you know and a Fees Notice will be
issued to you.  In that case you would need to pay the fee before we
proceeded with your request,  but we will offer assistance and advise you
if, by modifying your request, we could provide you with some non-exempt
or free of charge information.

Further to your application to access information under the Freedom of
Information Act (ANHSFT REF. 4745) please find our response below.  

Our Health Records team have provided the responses. 

 

1.  What documentation is provided to be completed by service users who
begin, are undergoing, or have completed (including having been assigned a
new NHS number) gender reassignment in order to change their details held
by the trust?

We would update via the Spine (service user would have already changed
their GP record) or we ask for proof of name change i.e. passport, Deed
poll, etc. No other documentation needed by us.

 

2.  What systems are in place in relation to handling patient records,
both electronic and hard copy, for service users held in a previous and
current identity? Including alert systems, quarantining, linking of
records, data security, data accuracy, etc.

We would manage the paper copy as a standard duplicate record (unless
specifically requested otherwise)

 

3.  What systems and policies are in place in relation to services users,
new and existing, who refuse to disclose their previous medical history in
relation to previous identities and gender reassignment?

Not sure we understand this question. If they are new service users, we
wouldn’t know if they had declined this, other than dissenting from
‘sharing’ GP records. If they are a current service user we would already
have the historic information. Clinical care would take presidence over
‘the rights of erasure/deletion’. A facility to anonymise or provide a
summary of care could be provided.

 

4.  What systems and policies are in place regarding service users who
obtain a gender recognition certificate? None currently as far as we are
aware

 

5.  What systems, reviews and oversights are in place to ensure the trust
is reviewing and updating its policies and practices in relation to
service users who are or have undergone gender reassignment, those who
obtain a gender recognition certificate, and for complying with changes in
legal requirements and regulations in relation to gender reassignment?

As far as we are aware all data subjects are treated the same, regardless
of the data or identity issue. We have no specific policies in relation to
gender reassignment that we are aware of from a record keeping point of
view.
