Dear Guildford Borough Council,

I would like to make an FOI request for voter data from the 12th December 2019 General Election. Specifically, I would like the following info:

- how many people were registered to vote by post in your constituency?
- how many postal votes were received?
- how many votes were marked as invalid?
- what was the result of the postal vote by party? If easier, just including the top 3 parties is fine.

INFORMATION REQUEST REFERENCE: FOI2019/01445
 
I refer to your recent request under the Freedom of Information Act 2000,
in respect of matters relating to postal votes at the recent General
Election on 12 December. 
 
In response, I can confirm that the (Acting) Returning Officer does not
carry out the duties on behalf of the local authority but in their own
personal capacity. A list of public bodies and local authorities that are
subject to the provisions of the Freedom of Information Act is included in
Schedule 1 to the Freedom of Information Act 2000.  A list of public
bodies that are subject to the provisions of the Freedom of Information

As you will see, the Freedom of Information Act does not list any person
appointed under the Representation of the People Act 1983. The (Acting)
Returning Officer is not subject to the provisions of the Freedom of
Information Act.  As such, the Council is not obliged to respond to this
request, but in the interest of transparency, I have provided some of the
information you have requested.  My response is in red below:
 
- how many people were registered to vote by post in your constituency?
18,390
- how many postal votes were received? 16,193
- how many votes were marked as invalid? 192
- what was the result of the postal vote by party?  Information not known
as all postal votes are added to the votes cast at polling station before
being sorted and counted for each candidate.
 
Your right to ask for an internal review

with the way I have dealt with your request, you may write to ask the
Council to review my decision. Another officer will carry out a review and
they will then write to you, letting you know whether they agree with my
decision or whether they have reached a different conclusion.

believe we have failed to meet our obligations to deal with your request
for information. Please remember that they will usually only consider
appeals after the Council has had the opportunity to carry out an internal
