Dear Lisburn and Castlereagh District Council,

The information I have requested is environmental information, as defined in Regulation 2(1) of the Environmental Information Regulations, it is exempt from disclosure under Section 39 of the Freedom of Information Act 2000. However, I want our Council to consider my request under regulation Section 74 of the Freedom of Information Act to consider my request under the Environmental Information Regulations 2004, which gives me the public qualified rights to access to environmental information held by a public authority. I wish our Council therefore to considered my request under the Environmental Information Regulations.

1. Can you confirm if EHOs from our council has visited/inspected the newly opening Chinese takeaway in Carryduff "wok this way" beside the roundabout?

2. With the recent explosion in Ballyhackamore (Clay Oven) Chinese restaurant which encountered a gas explosion after just 2 days of opening, with the opening of the new Chinese restaurant in Carryduff "Wok this way" what inspections to this property have EHOs done to ensure Gas Regulations at all stages have been met?

3. Can you send me any gas related inspections, purge/pressure test certs and documentation in relation to this property and any on site risk assessments which were carried out by our EHOs or gas installers at the new "wok this way" restaurant

4. Can you confirm that the works at this newly opening Chinese restaurant "Wok this way" were published in the NI10?

5. Can you confirm if CO and CO2 monitoring has been installed and tested at "Wok this way" restaurant? if not why not

6. Can you confirm that the CO/CO2 monitoring has been interlocked with the gas supply at the "Wok this way" in Carryduff? if not why not.

7. Can you confirm at "wok this way" that the purpose provided incoming air for the gas appliances has been calculated and meets current legislation and gas standards? if not why not

8. Can you confirm at "wok this way" that the purpose provided air has also been interlocked to the gas supply? if not why not

9. Can you confirm at "wok this way" that the installation and appliance testing were installed by a Gas Safe registered engineer and is appropriately qualified to carry out commercial catering installations and testing? if not why not

10. Can you confirm that a gas safe certificate has been issued to our council or the property owner "wok this way" and the installers name has been confirmed as competent? if not why not if this has been provided please send me a copy

11. Can our council ensure ALL gas safety criteria has been met and members of the public should not be concerned in any way?

I am writing to request an internal review of Lisburn and Castlereagh District Council's handling of my FOI request 'Gas Safety In Our Borough / EHO role in gas environments'.

[ the response has not ben given within the "Long Stay" time period of a Maximum duration of 20 days this is in breach of current regulations also not requesting additional time to provide a response is totally unacceptable and this issue will be reported to the ICO for their consideration under "Casework" where I have submitted several previously and my complaint investigated and upheld.

in addition to the unanswered questions as listed above which simply require yes or no answer and are in NO way in breach of private or confidential information and any request for documentation names, addresses, any conceivable personal details can be detracted prior to their disclosure to myself.

Further to viewing the photographs enclosed there appears to have been some very minor alterations which have been frustrated by persons unknown in blocking up the provision of fresh air for combustion and allow inadequate extraction of products of combustion from the Wok cooker and two Type B appliances.

1. With the blocking of fresh air for combustion give rise to potential of carbon monoxide and carbon dioxide poisoning as there will be inadequate permanent air flow in to allow air movement through the canopy.

2. In the photograph steam from the food is seen to rise vertically and not even to try to move towards the canopy. Whilst steam is visible POC’s are not. This draws into question the capability of the installed extract system to maintain adequate face velocity to capture all POC’s. The extract system is a POWERED FLUE system to primarily remove POC’s. This system requires commissioning with velocity readings taken in the extract duct giving consideration to Eddie currents at bends and transitions. When the correct velocity is achieved the controller needs set to insure the minimum safe velocity cannot be turned down. The interlock system (IF PRESENT?) should cut off the gas if the fan is not maintaining the required flow rate.

3. Visual inspection on site shows no sign of either Co2 or Co monitoring which is required to be interlocked to the gas supply? Is this present or have the council, HSENI, Gas Safe given a relaxation to the standards?

4. The positioning to the fryers next to the wok cooker creates a hazards of hot oil burns. The wok cooker is higher than the fryer which is directly adjacent to the wok cooker with a water top and chefs clean woks using water to cleanse each wok after cooking and tip it onto the draining top. If water is splashed into the hot oil of the fryer this flashes to steam ejecting hot oil which can cause burns and injury. How was this not picked up at the visit?
Where those present properly trained in commercial catering?

5. With the fan running so slow it calls into question is there an interlock system present or is it the old classic of wiring the solenoid valve into the output of the fan controller so the solenoid valve comes in and out with the fan switching on. This fails to prove the fan is working as the fan motor can fail but still have a power supply but the gas would remain on. Is there a proper interlock system without a bypass, emergency stop buttons at exit routes with non mushroom head switches correctly labelled?

6. Do all the appliances have either CE or BS compliance with readable data badges and manufacturers instructions present on site?

7. Please Confirm if "Gas Safe" has visited the premisses since our last communication? yes or no

8. Please confirm if "Health and Safety Executive" has visited the premises since our last communication? Yes or No

9. Does the council have in their procession confirmation that the installation complies with the following standards?

BS 5440-2
BS6173
Test carried out to BS 8494
Tests carried out using equipment to BS EN 50543
Does the council have a complete CP42 for the property given it’s a new installation and therefore should meet all current regulations?

In Great Britain, the (GS(I&U)R) Reg 35 is the primary legislation concerning the maintenance of gas systems and appliances in domestic and commercial installations. Together with duties under the Health and Safety at Work Act etc. and Provision and Use of Work Equipment Regulations (PUWER), this requires employers/self employed persons and users to ensure that gas appliances, flues, pipework and safety devices are maintained in a safe condition to prevent the risk of injury to any person, (see Notes).
Note 1: Similar requirements apply in other geographical areas covered by Gas Safe Register. For details of current gas safety legislation, building legislation and industry standards for the geographical areas covered by Gas Safe Register, see the Legislative, Normative & informative document list at: https://engineers.gassaferegister.co.uk. – login and visit the Technical Information area (see IGEM/UP/19).
Where practicable, users need to be advised that the frequency of servicing and testing of ventilation systems is to be based upon the manufacturer’s instructions and the use of the catering equipment, but otherwise at least yearly will be a reasonable minimum frequency (this also applies to the gas installation).
It is the responsibility of the employers/self employed persons to ensure that all safety interlocks and environmental detectors (CO2 detector heads) and safety controls are maintained and checked for calibration as specified by the manufacturer. Failure to perform such tests may result in undetected failure and thus unsafe conditions (see IGEM/UP/19).
Air supply and extract air systems and associated interlocks need to be routinely serviced to ensure their continued safe operation. This needs to be done by competent personnel such as appropriately qualified service engineers (see IGEM/UP/19).
There are also implications under PUWER for the occupier or employer to ensure that safety systems are working correctly. The manufacturer of safety and interlock systems will provide information on the maintenance instructions and procedures for the items of equipment being supplied. It is important to ensure that such maintenance is performed by competent persons and that any remedial works following maintenance are actioned with due diligence (see IGEM/UP/19).

failure to comply and disclose the information requested providing clear and transparent accountability
it will be accepted that the standards set by Lisburn and Castlerea Council failure to ensure compliance to current legislation in regards to catering sheets, legislation EHO, Gas legislation also encumbering prosecution against those who systematically put lives at risk via EHOs and Building Control Officers clearly working way outside their skillset and honestly dont know "what is right or wrong"

unfortunately this is the second visit and it is clear inadequate dangerous practices are prolific and putting staff and the public at risk of potential death.

if safe strategic solutions are not put in place I will turn my evidence over to the press and media to highlight the failing of Lisburn and Castlerea Council and maybe you will answer their questions when prompted.

Review. I can confirm that the response has been returned late due to a
misunderstanding by officers with two information requests received from
yourself in November. One was responded to on Friday 7^th December and the
second has now been answered below under the points you raised.

 

1. Can you confirm if EHOs from our council has visited/inspected the

Yes.

The Council have received a Gas Safety Certificate, as they would with any
gas installation within a commercial premise. The Certificate contains
information on the Gas Safe Engineer, Types of Gas Appliances, Mechanical
Ventilation flow rates and Combustion Checks.

 

3. Can you send me any gas related inspections, purge/pressure test certs
and documentation in relation to this property and any on site risk
assessments which were carried out by our EHOs or gas installers at the
new "wok this way" restaurant

We hold some of this information namely, the Gas Safety certificate.  This
information is exempt under Section 30 (1) Information held by a public
authority is exempt Investigations and proceedings (Section 30) (b) any
investigation which is conducted by the authority and in the circumstances
may lead to a decision by the authority to institute criminal proceedings
which the authority has power to conduct) of the Freedom of Information
Act as it has been gathered as part of our health and safety inspection/
investigation.  This is a qualified exemption and is subject to the public
interest test.  The Council has considered whether it is in the public
interest to release this information and do not believe it should be
released as it will discourage businesses from cooperating with the
Council in their statutory role.

 

4. Can you confirm that the works at this newly opening Chinese restaurant
"Wok this way" were published in the NI10?

The Council do not have responsibility for NI10, this is operated by HSENI
and therefore is not a requirement for the Council.

 

5. Can you confirm if CO and CO2 monitoring has been installed and tested
at "Wok this way" restaurant? if not why not

The Council request a Gas Safety Certificate only from a commercial
catering premise with a gas installation. Monitoring of CO and CO2 is not
required.

 

6. Can you confirm that the CO/CO2 monitoring has been interlocked with
the gas supply at the "Wok this way" in Carryduff? if not why not.

The Council do not require CO/CO2 monitoring and require a Gas Safety
Certificate only.

 

7. Can you confirm at "wok this way" that the purpose provided incoming
air for the gas appliances has been calculated and meets current
legislation and gas standards? if not why not.

As advised above, the Council only request a Gas Safety Certificate. It is
the Gas installer’s responsibility to ensure the all standards relating to
gas safety are met and that they are registered a Gas Safe Engineer.

 

8. Can you confirm at "wok this way" that the purpose provided air has
also been interlocked to the gas supply? if not why not.

As detailed above in question 7.

 

9. Can you confirm at "wok this way" that the installation and appliance
testing were installed by a Gas Safe registered engineer and is
appropriately qualified to carry out commercial catering installations and

Yes, the gas installation was commissioned by a Gas Safe Engineer.

 

10. Can you confirm that a gas safe certificate has been issued to our

At the time of the inspection a Gas Safety Certificate was received which
confirmed that the installation has been approved by a Gas Safe Engineer.

having raised concerns in other councils where Environmental Health Officers have failed in their duty and in other councils they have courteously provided detracted documentation to support claims and i have only submitted 1 FOI to my council, it must get confusing as i attached additional questions to the FOI so there is only the one for you to address.

the particular area is the area around providing DETRACTED documentation to support compliance of the Gas Safety and use regulation Northern Ireland 2004 of which my council are the enforcing authority, having allegedly previously visited the premises in question i want all documentation detracted where applicable to conform with current GDPR .

if other councils can provide this information why are Lisburn and Castlereagh City Council choosing to conceal this vital information which will demonstrate accountability and transparency and demonstrating enforcement where required.
I have also arranged a meeting with the EHO director in February to raise concerns of compliance

I have exhausted every avenue to assist you in making the correct decisions when responding to my FOI requests.

Dear Sally Courtney,

The documented information I have requested and I want to make this clear is for detracted documentation with the traceable names , addresses and any other conceivable traceable identification removed from the documents this would be outside of section 30B of the freedom of information act as it will not disclose personal data.

As you are clearly concealing information which I believe should be disclosed (detracted) I am left with no alternative to lodge my concerns with the ICO under “casework” for there judgement and intervention in this matter.

I will allow an addition 5 days prior to submitting this correspondence to the ICO so I can display consideration to my council and providing my council an additional chance to issue the requested information. Outside of the 5 days I will submit my concerns.

Further to our meeting yesterday, 7^th February 2019,  it was agreed to
provide you with correspondence answering a number of points discussed at
that meeting. As a consequence, you confirmed to me at that meeting that
our response would be sufficient to satisfy your FOI’s dated 12^th
January, 13 January and 25^th January and there was no need to provide a
separate response. I am therefore closing your FOI requests and you will
