I am writing to request an internal review of Torfaen Council's handling of my FOI request 'Funding used'.

I am dissatisfied by the response received and the officer that provided the information (David Jeremiah, Officer A, Public Services Ombudsman for Wales Public Report).

David Jeremiah, Officer A, was found guilty by the Ombudsman of inaccurate record keeping, of information held by Torfaen Council. Furthermore, the Ombudsman found that David Jeremiah, Officer A, would alter facts when informants were being protected by Torfaen County Borough Council. Proven when David Jeremiah's Department was found guilty of re-typing Family Y's evidence supplied to Torfaen's Community Safety Department.

You have asked for a review of the Council’s decision in relation to your
original request sent by Email dated 25 February 2009 as follows:-

By Email the Council responded on the 3 March 2009 stating:-

 

“There is no funding allocated to the use of informants and the protection
of informants and therefore no expenditure.”

 

Separately and prior to that Email on the 2 March 2009 you received a
direct response from one of the officers who was asked to provide
information to the Council’s Freedom of Information Officer who was
dealing with your original request.  That officer stated in the Email to
you as follows:-

 

I am the community Safety Manager for Torfaen Community Safety
Partnership.  I can confirm that I spend no money on informants nor do I
spend any money on protecting informants in pursuance of my
responsibilities under RIPA.  

 

 On the 3 March 2009 you Emailed the Council requesting an internal review
of the Council’s handling of your FOI request “funding used”.  You stated
that “I am dissatisfied by the response received and the officer that
provided the information”.

 

I have reviewed the decision of the Council in relation to the response
you received which was there was no funding allocated to the use of
informants and the protection of informants and therefore no expenditure.

 

I am satisfied that that is an accurate response.  In reviewing the
decision, I have paid particular attention to that section of the Council
(Community Safety) which provided information for that response and which
you have indicated is not satisfactory.

 

I have required specific information from the Finance Department which has
confirmed there is no Council budget or costs separately identified on
unique codes which relates to this matter.

 

I have also received confirmation from the two relevant Chief Officers who
between them have had management responsibility for the Community Safety
Team of the Council, that no money was spent on the use of informants or
on protecting informants.

 

On that basis I am satisfied that the Council has given you the correct
information in its original decision. 

 

If you are not content with the outcome of this review, you may apply
