Dear Christopher

Please find below the information requested in your freedom of information
request.  Under the Data Protection Act 1998 and 2018, guidelines state
that financial information should be retained by local authorities for 6
years after the last financial year.  We do have information readily
available going back to 2010/11 which I have provided but can not
guarantee that this is an overall all-time figure as you request in point
A.  Additionally, under Data protection regulations we are not prepared to
provide individual names or points of contact.

Dear Knox, Christine,

I thank you for your response however there are some points I would like to clear up. Firstly you state that it is a legal requirement to only keep information for the last 6 years after the previous financial year. However you did not confirm whether these are the only records the Council hold. Can you confirm whether this is the case that the Council holds NO information prior to 2011/2012?

Second, you refused a part of my FOI under data protection grounds. Could I please ask which data protection regulations and sections of acts you are refusing those parts under.

Yours sincerely,

Christopher Marshall

I can confirm that the Council holds information that you have asked for, but in this case we will not be providing it to you as it is exempt from disclosure.
We are not obliged, under section 40(2) of the Act, to provide information that is the personal information of another person if releasing would contravene any of the provisions in the Data Protection Act 2018 (DPA). In this instance we believe that the release of this information would contravene the first data protection principle and therefore section 40 (2) is engaged.
The terms of this exemption in the Freedom of Information Act mean that we do not have to consider whether or not it would be in the public interest for you to have the information.”
