Dear Liverpool City Region Combined Authority,

We have been told that both Frank Rogers and Mark Bousfield left the Combined Authority last week “almost overnight”. We understand both were subject to complaints and possible internal investigations into conduct/conflict of interest concerns. Given that both appear to have been either present at the committee or actively involved in the Festival Gardens project we wish to put on record that we would expect all correspondence to be retained by the CA and to not be disposed of. To date, there have been occasions where the CA has failed to provide materials when asked for them claiming that a search of records has not shown them.

We are concerned that the exit of these people may be used as an excuse to not properly disclose information that highlights. Further to this, please answer the following.

Is there or was there any investigation or internal review underway into the conduct of Frank Rogers at any point in the last 6months?

Is there or was there any investigation or internal review underway into the conduct of Mark Bousfield at any point in the last 6months?

Given both are leaving at short notice (Frank Rogers was due to leave in September and this seems a hasty move from that date) is it right to interpret the exits as an attempt to close down complaints and investigations early?

Would either have faced disciplinary action if retained?

Frank Rogers was present at the investment panel Chaired by James Gill which approved the Festival Gardens project where Mr Gill was also acting on behalf of a Company that would benefit from the £27m approved. Did Frank aRogers not act to stop this and is this a reason for his exit?

You have requested information regarding the employment record of an individual. Such employment information constitutes personal data as defined by the Data Protection Act 2018. When personal data is sought under a Freedom of Information Act 2000 request, the Authority needs to consider the competing rights under each piece of legislation. Having done so, the Authority concludes that it is appropriate to neither confirm or deny the existence of such information.

• Is there or was there any investigation or internal review underway into the conduct of Mark Bousfield at any point in the last 6months?

You have requested information regarding the employment record of an individual. Such employment information constitutes personal data as defined by the Data Protection Act 2018. When personal data is sought under a Freedom of Information Act 2000 request, the Authority needs to consider the competing rights under each piece of legislation. Having done so, the Authority concludes that it is appropriate to neither confirm or deny the existence of such information.

No. In providing any response to a Freedom of Information Act 2000 request, it is not appropriate for the Authority to confirm or otherwise, any inferences made by individuals.

The Investment Panel did not, and does not, have the power to approve or reject any funding awards for projects. Decisions whether to fund a project such as the Festival Gardens or not, are the sole responsibility of the Combined Authority.
