Footpath or Beer Garden
Dear Chorley Borough Council,
I assume you can answer this question well within the usual 28 days. Yesterday, I was in the Sir Henry Tate pub in town and noticed they have placed a sign outside which states "No smoking in the beer garden". The said "beer garden" is actually a fenced off area of the footpath in front of the main entrance.
Can you clarify if Wetherspoons have:
1; Any ownership of the area of footpath they claim to be their beer garden?
2; If the footpath is public owned, do they have permission to utilise the footpath in such a way?
3; Any right to deny people the right to smoke outdoors in a completely unsheltered area?
