Food Premises Register

The request was partially successful.

Dear Havering Borough Council,

Under The Freedom of Information Act and the Environmental Information Regulations that requires each public authority to produce, maintain and make available a publication scheme in the interests of openness and accountability I write you to request a list of every food business in your borough which is currently operating. On the list I would like the following information on every business:

1. Address and postcode
2. Name
3. Date of last inspection
4. Score of last inspection
5. Class use of business (a1 or a3)
6. Brief description of business

Also I would like the information in the form of an excel spreadsheet.
I would much appreciate if you could email me the information requested as soon as you can.

Yours faithfully,

Ileana Mihuta

Dear Ileana Mihuta,

Access to Information

I refer to your request for information made under the Freedom of
Information Act 2000.  Your request has been considered and the
information held by Public Protection is as follows:

Question 1 I would like the information in the form of an excel
spreadsheet.

I write you to request a list of every food business in your
borough which is currently operating. On the list I would like
the following information on every business:

1. Address and postcode

2. Name

3. Date of last inspection

4. Score of last inspection

5. Class use of business (a1 or a3)

6. Brief description of business

Response 1, 2, 3, 4 - The information requested is already published via
given by the Food Hygiene rating Website
Public [1]http://ratings.food.gov.uk/authority-sea...
Protection  and can also be downloaded via the reuse of data via an
application programming interface (API) from the FSA website
[2]http://ratings.food.gov.uk/open-data/en-... this data is
already cleansed for data protection purposes, so will not show
full postcode details for those businesses operated from a
private address.

5. Information regarding the use class of the business –
information not held by Public Protection.

Although we upload all our data, only those “included” in the
scheme, or “included and private” are published.  There are a
number of “sensitive” premises that are not published.

There are also a number of “excluded” premises (EXC) which are
large manufacturers that the FSA has considered too complex to
be included in the scheme. There are also a number of “exempt”
premises (EXE) these are premises selling food but not
recognised by consumers as selling food such as newsagents only
selling wrapped confectionary or chemist shops that also sell
wrapped food products, a full description is published in the
FHRS brand standard.

In accordance with the Act / Regulations, this email also acts as a
Refusal Notice and details of the exemption/s applied is as follows:

Exemption under section: Section 21

Information the exemption applied to: Q1-4

Reason for applying the exemption: Already publicly available

Public Interest Test: Not applicable

In accordance with the Act / Regulations, this email also acts as a
Refusal Notice and details of the exemption/s applied is as follows:

Exemption under section: Section 40

Information the exemption applied to: Personal names and addresses

Reason for applying the exemption: To release this information in to the
public domain would breach the principles of the Data Protection Act

Public Interest Test: Not applicable

Regarding Question 6:

Your request for information has been researched and I am unable to
provide you with the specific information you require.

This is because the cost of locating and retrieving the information
exceeds the 'appropriate limit' as stated in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004. It is estimated that it
would take in excess of 18 hours to comply with your request.

In accordance with the Freedom of Information Act 2000 this email acts as
a Refusal Notice.

You may wish to refine and resubmit your request so that it reduces the
cost to within the 'appropriate limit'.

Question 1 6. Brief description of business
Response given by 6. Request for a brief description of the business. This
Public Protection information could only be retrieved by opening each
premises record individually, viewing the record and
transferring the information by copy and paste to a
spread sheet, I estimate that this would take 2 minutes
per record multiplied by just over 2000 records, 66
hours work.

I apologise that your request cannot be met in full and trust the above is
of use to you.

You have the right of appeal against our decision. If you wish to appeal
please set out in writing your grounds of appeal and send to the above
address.  Please ensure that you quote our reference on any correspondence
to us.

I trust the information is of use to you and will close your request.

If you are dissatisfied with the way in which your request has been
handled you have the right to make a complaint.  Please put the details in
writing and return to me at the above address, your complaint will then be
dealt with in line with our corporate complaints procedure.  You also have
the right to complain to the Information Commissioner at the following
address:
