I would like to make an FOI request about the following statistics in the previous annual period. If figures are recorded in calendar year this would be 2017, if financial year 2017-18. If available in both, I would prefer calendar for comparison to central government FOI statistics.

2. How many FOI requests have you received? (if this figure includes EIR requests, please state)
3. The number of requests where the information was granted?
4. The number of requests where the information was entirely withheld (no information provided)?
5. The number of requests where the information was partially withheld (some, but not all information requested, provided)?
6. How many requests were completed inside the statutory deadline?
7. How many requests were appealed to internal review?
8. How many decisions were upheld at internal review?
9. How many FOI decisions have been appealed to the ICO?
10. How many decisions were upheld by the ICO?
11. How many vexatious requests were received?

I am writing in response to your request dated 26 June 2018.  This has
been dealt with under the Freedom of Information Act 2000.

 

The Council’s response to your specific questions is set out below:

 

I would like to make an FOI request about the following statistics in the
previous annual period. If figures are recorded in calendar year this

7 were upheld and and additional 4 were partially upheld

5 complaints made to the ICO were passed on to the Council by the ICO in
2017/18

 

10.   How many decisions were upheld by the ICO?

 

The ICO has not provided a formal decision on all the 5 complaints
referred to above, however the Council has recorded the outcomes as:

 

a.       Local resolution; additional information provided to applicant by
agreement with the ICO and the applicant.

b.      ICO notes a response was not sent within deadline and requires
response to be sent within 10 working days or receipt of letter; this was
done.  No further action required by ICO.

c.       ICO notes a response was not sent within deadline but that the
response has since been sent with an apology. No further action required
by ICO.

d.      ICO issued a decision notice upholding the complaint that a
response was not sent within deadline, but not upholding the complaint
about the application of s40(2) (personal information).

e.      ICO notes a response was not sent within deadline but that the
response has since been sent with an apology. No further action required
by ICO.

 

11.   How many vexatious requests were received?

 

One request was determined to be vexatious.

 

If you are not content with the handling of your request, you have the
right to ask for an internal review.  Requests for internal reviews should
be submitted within 2 months of the date of receipt of the response to
your original request and should be addressed to the Monitoring Officer,
