I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

• What are the contractual performance KPI's for this contract?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract, from the start of the contract to the current date
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

What are the contractual performance KPIs for this contract?

Suppliers who applied for inclusion on each framework/contract and were
successful  at the PQQ & ITT stages.
Three bids were received, there was one successful supplier: Carter Jonas
LLP.

Actual spend on this contract, from the start of the contract to the
current date.
The total financial spend on this contract from the start date 01/04/2022
to 19/10/2023 is £9,918,355. 

Start date & duration of framework/contract?
Start Date: 1 April 2022
End Date: 31 March 2024
Extension period: + 1 year to 31 March 2025.

Could you please provide a copy of the service/product specification given
to all bidders for when this contract was last advertised?

Is there an extension clause in the framework(s)/contract(s) and, if so,
the duration of the extension?
The awarded contract had the option to extend for a further 4 years in two
year intervals.

Has a decision been made yet on whether the framework(s)/contract(s) are
being either extended or renewed?
National Highways intends to extend the current agreement by one further
year calling on Clause Z54.1 of the contract data which states “The Client
may notify the Contractor that the Service Period is to be extended by the
extension period or such lesser period as the Client may specify.”
 

Information withheld

Suppliers who applied for inclusion on each framework/contract and were
not successful at the PQQ & ITT stages.

This information has been withheld under the exemption at Section 43(2) of
the Freedom of Information Act 2000 - Commercial prejudice - because it is
considered to be commercially sensitive and not considered to be in the
public interest to release.

In applying this exemption, we have had to balance the public interest in
withholding the information against the public interest in disclosure. The
key public interest factors for and against disclosure are attached.

 

Who is the senior officer (outside of procurement) responsible for this
contract?

This information has been withheld under the exemption at Section 40 (2)
of the Freedom of Information Act 2000 - Third party personal data. 

This is an absolute exemption and therefore does not require a public
interest test however we can advise that the Senior Responsible Owner’s
(SRO) name is not in the public domain, and they do not want it shared. As
such, any disclosure would be unfair, and would contravene the first data
protection principle and hence Section 40 (2) is found to apply.
