Dear Information Commissioner's Office,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Information Commissioner's Office's handling of my FOI request 'FOI monitoring list'.

The exemption at section 31(1)(g) of the FOIA refers to circumstances where the
disclosure of information “would, or would be likely to, prejudice – … the exercise
by any public authority of its functions for any of the purposes specified in
subsection (2).”
In this case the relevant purposes contained in subsection 31(2) are 31(2)(a)
and 31(2)(c) which state –
“(a) the purpose of ascertaining whether any person has failed to comply with
the law” and
“(c) the purpose of ascertaining whether circumstances which would justify
regulatory action in pursuance of any enactment exist or may arise …”

Doesn't make sense. If they don't want to be monitored, comply with the law. If they are monitored it's cause they broke the law. so why keep it secret. what's that achieve. No wonder there's so many don't comply.

Where a significant cyber incident occurs, you may also need to report
this to the National Cyber Security Centre (the NCSC). To help you decide,
you should read the NCSC’s guidance about their role and the type of

Incidents that might lead to a heightened risk of individuals being
affected by fraud, should be reported to Action Fraud – the UK’s national
fraud and cybercrime reporting centre. If your organisation is in
Scotland, then reports should be made to Police Scotland.

If you are a Communications Service Provider reporting a security breach
under the Privacy and Electronic Communications Regulations – you will
need to report the security breach via this [10]secure portal.

If you represent an organisation and are reporting a potential incident
under the NIS Directive - we will contact you as soon as we can. You can

If you represent an organisation and you are reporting a security breach
within the definition of the eIDAS regulation – we will contact you as

have indicated that you do not consider it meets the threshold for
reporting, you may not receive a response from us, or we may respond by

Where a significant cyber incident occurs, you may also need to report
this to the National Cyber Security Centre (the NCSC). To help you decide,
you should read the NCSC’s guidance about their role and the type of
incidents that you should consider reporting.  

Incidents that might lead to a heightened risk of individuals being
affected by fraud, should be reported to Action Fraud – the UK’s national
fraud and cybercrime reporting centre. If your organisation is in
Scotland, then reports should be made to Police Scotland.

If you are a Communications Service Provider reporting a security breach
under the Privacy and Electronic Communications Regulations – you will

If you represent an organisation and are reporting a potential incident
under the NIS Directive - we will contact you as soon as we can. You can

This case reference number relates to your information request made on 9
September, which we are working on, our response being due on 7 October.

When you say ‘you’ve got my complaint’ I am unclear as to which complaint
you are referring to. If, on receipt of our response, you are unhappy with
the outcome, you can request an Internal Review via What Do They Know. If
we do not respond to your request on time and you wish to make a complaint
to the ICO as regulator then you will need to do this via the form on our
website.

Making a complaint to the ICO as regulator is a separate function from
requesting information from us and is not supported by the What Do They
Know website. This is the same process you would follow if you wanted to
complain to the ICO about the handling of an FOI request made by you to
any public authority. More advice is provided on [1]this page  on What Do
They Know
