FOI escooter request

We're waiting for Holly Bancroft to read recent responses and update the status.

Dear Derby City Council,

Please can you provide all correspondence received and any internal correspondence regarding the Wind e-scooters from the start of the trials on 25th November 2020 to the present day please:

This should include, any correspondence from:
- the general public
- elected councillors from Derby Council from the start of the trial
- any representatives of Wind scooters
- any correspondence from people that have injured themselves involving a rentable e-scooter. To include those who have tripped over one, been injured by one or anyone that has fell off one, or has been injured in any other way involving a Wind e-scooter.
- This is to include all complaints/correspondence to parking and people riding them.

Can you also please provide all police reports submitted to the Council relating to the ongoing e-scooter trials and any correspondence from the council to the police on the Wind e-scooter trials.

If there any issues with this request, please email back and I can tailor the request.

Dear Holly,

I acknowledge your request for information received on 29/06/2021 about
‘all correspondence received and any internal correspondence regarding the
Wind e-scooters from the start of the trials on 25th November 2020 to the
present day.’

 

Unfortunately, the Council is unable to identify the information you have
requested from the details in your request.

 

Please provide clarification below, so we can search if we hold the
information.

 

Can you please clarify what you mean by correspondence? Please give
specific examples such as, letters etc.

 

Please can you clarify the specific information you require that is
contained in the emails? Section 12: Exceeds appropriate limit exemption
would likely apply to the request because searching and extracting the
emails and other listed correspondence would take longer than 18 hours.

Please be advised that the additional following exemptions may also apply
to this request:

Section 40(2) Personal data third party by virtue of section 40(3)(a)(i)
would likely apply to the request. This is because emails and
correspondence may contain details relating to employees below senior
management level and third party data, such as names.

 

Section 41: Information provided in confidence would likely apply to the
request. This would apply to information or communications sent in
confidence by third parties involved in the project.

 

Section 43(2): Commercial interests would likely apply to the request.
This would be applicable to any cost and pricing details, information that
would be considered commercially sensitive.

We won’t be able to deal with your request until you provide the
additional information.   

The Freedom of Information Act 2000 says that we must comply with your
request for information within 20 working days, from the date following
receipt of your request unless we have to ask for clarification, as in
this case. The 20 day response deadline clock has stopped from the date of
this email, the clock will reset from the date we receive your response
clarifying your request and we will advise you of the new 20 working day
deadline at this stage.

Unfortunately, if we don’t hear from you by 06/09/2021, we will send you a
refusal notice because we have not received all the information we need to
deal with your request.

We sent you a clarification notification on 5/7/21 asking for more
information – see attached.

 

Unfortunately, we have not received your response and your request has
been closed.  This is because the Council is not required to comply with a
request if we do not receive all the information we need to identify and
