Streetscene and City Services

The waste is investigated to find evidence of the person who had fly
tipped (on Council maintained land). If we found evidence, we would pursue
this and remove the waste, however the waste is removed regardless if
there is evidence or not.

Environmental Health

 

No fines (FPNs) or court action taken or ‘works in default’ carried out to
‘clear or dispose’ of fly tipped / dumped waste on our system during the
financial year 2017-18.

Please be aware that the Community Safety Warden Service and Noise &
Neighbourhood Team only deal with items fly tipped/dumped on
(residential/commercial) private land and if the materials are classed to
be "Inert Waste" i.e. waste which is NOT hazardous to the environment or
harmful to human health, such materials will not be removed at public
expense.  However, this also will depend on the type or amount of waste
concerned - Incidents of this nature will be categorised and if necessary
referred to NRW.

In addition, the land managers, occupiers or owners of private land are
responsible for ‘clearing and disposing’ of any fly-tipping / dumped waste
found on private land, Local Authorities will not normally clear such
items, however, they do have the discretion to choose whether to
investigate such incidents on private land depending on the level of
evidence and the likelihood of a successful prosecution, but they still
have no obligation to clear fly-tipped /dumped waste.
