Flooding at Junction of Chapelfield Road and Mill Road, Stalham

Dear Norfolk County Council,
During the winter months of 2020/21 the rainwater has often completely flooded the road surface at the junction of Mill Road in Stalham and Chapelfield Road, and extending north west along Chapefield Road for approx 250 mtrs. at times to a depth of more than 150cm, making it impassable for many of the numerous walkers around these backroads.

I noticed yesterday morning, 26th Mar, 3 vehicles (2 tractors and a small truck) arrived and attempted to clear the inlets from the road to the ditches to enable the water to run away.

Under the FOI Act I would appreciate it of you could provide me with the contractors details, the contract terms relating to it and the invoiced value for the work.

I refer to your request for information dated 27 March 2021.

 

You asked:

Our response:

 

It is confirmed that grip cutting works were carried out in or around the
above area, on that date.  The works are routine maintenance of clearing
grips which are carried out on a yearly cycle, it was not work intended to
alter or change any drainage features, just a cleansing.  The works were
carried out by selecting a contractor from a framework contract with set
prices per item.

 

The works were delivered through Norse Highways as the principal
contractor.

 

Your request regarding the invoice value has been considered and is
refused.

In accordance with the Environmental Information Regulations 2004 (the
Regulations) this letter acts as a Refusal Notice.

 

Exception

Regulation 12(5)(e) states that a public authority may refuse to disclose
information to the extent that its disclosure would adversely affect the
confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest.

Reason

 

The information that you have requested is the commercially sensitive data
of third parties from whom we do not have consent for release.

 

Public Interest Test Reasons

 

The Council has considered whether the public interest is maintaining this
exemption is outweighed by the public interest in disclosure.

 

This Council has considered the following reasons in favour of disclosure:

o Promoting accountability and transparency by public authorities for
decisions taken by them.
o Promoting accountability and transparency in the spending of public
money, and engagement in commercial matters.

 

Balanced against this are the following reasons against disclosure:

o Releasing this information could impede the County Council’s ability
to achieve best value and range of services for the people of Norfolk.
o This information is the commercial information of third parties and
was provided with the expectation that it will not be released into
the public domain.
