I refer to your request for information received on 06/04/2021. Please see
the information below in response to your request: -

 

Please provide a copy of the contract (including any appendices) between
the Council and the current provider (Brent, Wandsworth and Westminster
Mind) for the provision in the borough of the Wandsworth Floating Support
service.

 

Please find attached. We have redacted the pricing information and the
operational information outlined in the Method Statement, as we judge that
this information is exempt under Section 43 of the Freedom of Information
Act. Section 43 states that information is exempt from disclosure if its
disclosure would or would be likely to, prejudice the commercial interests
of any person, including the public authority holding it.

 

Disclosure of this requested information is likely to prejudice the
commercial interest of Brent, Wandsworth, Westminster MIND, as it could
weaken their position in a competitive market by placing market sensitive
information in the public domain, and to which other service providers
might refer should the Council decide to negotiate with other providers in
the future. Disclosure would also be likely to prejudice the Council’s
ability to secure the best possible value for any future contracts, as
companies may be unwilling to provide the full information required if
they believe this will be disclosed to competitors.

 

This exemption requires the Council to consider the public interest test
and, whilst the Council recognises the public interest in the transparency
of the procurement process, it must consider the strong public interest in
securing best value for taxpayers. In addition it could be considered that
some of the pricing costs and method statement is provided on a
confidential basis on the understanding that it will not be placed in the
public domain. As a consequence, the greater public interest lies in
withholding these parts of the requested information.

 

Under the terms of the Act, this letter acts as a partial refusal of your
request.

Dear Wandsworth Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Wandsworth Borough Council's handling of my FOI request 'Floating Support'

The council has withheld information in schedule 2 Annual Sum and Schedule 3 Method Statement quoting section 43 of the Freedom of Information Act.

However, when awarding the contract the council would have been required to include the contract value in the council resolution or officer decision which approved the contract award and I would therefore ask the council to provide a copy of schedule 2. The council will also be required to publish (and does publish) any payments to suppliers over a threshold value, so the annual sum will become apparent once the council has published the first 12 months payment figures. Again this rather negates the reason for withholding publication of this schedule. Please publish Schedule 2 or alternatively please provide a link to or copies of the resolution or officer decision when awarding this contract.

In its reasons for withholding publication of Schedule 3 Method Statement the council state:

"In addition it could be considered that some of the pricing costs and method statement is provided on a
confidential basis on the understanding that it will not be placed in the public domain."

which means that some of the information was NOT provided on a confidential basis.

Please consider publishing the Method Statement with only that information which the council reasonably considers was provided on a confidential basis redacted. Please also provide a fuller description of the reasons for and against publication that the council considered when operating the public interest test.

Please accept my apologies for the delay in responding to you, subsequent to the completion of the Internal Review, relating to your request.

As foreshadowed, the Council is now able to provide the following information:

1. Any part of the contract which revealed the value of the whole contract is public knowledge and should be disclosed.

Information already in the public domain - Initial contract term is four years. Estimated contract value over four-year period is £1,245,868.

2. Amount paid under the contract so far.
