The Local Authority is requested to provide a list of motor vehicles operated by the council (owned or leased) currently licensed with the Driver & Vehicle Licensing Authority (“the DVLA”). Please include the following details.

1. Registration Mark of each motor vehicle;
2. Fleet number allocated (if any);
3. Chassis Make and Model;
4. Type of Body fitted;
5. Date new or date of acquisition.

File attachments using Excel, Word, PDF or plain text are acceptable

We refer to your request for information BF576-1819.

Request:

The Local Authority is requested to provide a list of motor vehicles operated by the council (owned or leased) currently licensed with the Driver & Vehicle Licensing Authority (“the DVLA”). Please include the following details.

Response:

1. Under the Freedom of Information Act 2000 (FOIA) Babergh District Council (BDC) has applied the following exemption to this response and has not released registration information for the vehicle details provided.

Exemption applied:
31.—(1) Information which is not exempt information by virtue of section 30 is exempt information if its disclosure under this Act would, or would be likely to, prejudice -
(a) the prevention or detection of crime

As required Babergh District Council in applying this exemption has carried out a prejudice and public interest test in which the points below were considered:

The Prejudice test:

• Having released similar information other Local Authorities have had an increased level of vehicle thefts, releasing the requested registration information would result in the council suffering from these crimes and therefore prejudice the prevention or detection of crime.
• Having released similar information other local Authorities have suffered a number of false insurance claims, releasing the requested registration information would result in the council suffering from these crimes and therefore prejudice the prevention or detection of crime.
• Having released similar information other local Authorities have suffered instances of number plate cloning, releasing the requested registration information would result in the council suffering from these crimes and prejudice the prevention or detection of crime.

The Public interest test:

Points in favour of applying the exemption and NOT releasing the information -
• There is a very strong public interest in protecting the ability of public authorities to enforce the law.
• If the registration information is supplied it would lead to the theft of public assets and loss of public funds, this would at odds with the Council’s duty to protect public assets.
• Criminals could use this registration information to more easily commit crimes such as, theft of BDC vehicles, cloning of BDC vehicle number plates and making false insurance claims against BDC, to apply this exemption will protect the Council and society from the impact of crime.

Points in favour of NOT applying the exemption and releasing the information -
• Without such information being released the public may lack confidence and trust in BDC

It is as a result of considering the points listed above that Babergh District Council has applied exemption 31 (1) (a) and not released the vehicle registration information

Dear BMSDC Data Protection,

Thank you for your reply to my recent Freedom of Information Request.

I note your refusal under section 31 (detection/prevention of crime) and advise you of the Information Commissioner’s decision notice 67004 regarding the provision of registration mark/numbers part of which I reproduce below:

“The Commissioner is therefore not satisfied that the council dealt with this
part of the request in accordance with the requirements of Part I of the Act in
that it did not apply the exemption in Section 31 (1) (a) of the Act correctly in
withholding the information in question.
Following the intervention of the Information Commissioner’s Office, the
council has since provided the complainant with the information he requested
apart from that relating to vehicle identification numbers.”

I should be grateful therefore if you can reconsider your decision in the light of this information and look forward to hearing from you in the near future
