Fitness to Practice Concern Reports

We're waiting for Harry to read a recent response and update the status.

Dear General Medical Council,

I am writing to you under the Freedom of Information Act 2000 (“the Act”) to request the following information:

How many fitness to practice concern reports have been denied an investigation by your triage team over the past year where the allegations, if proven, would amount to an impairment of fitness to practise.

I look forward to your response within 20 working days, as stipulated by the Act.

Regards

Mr Wiess

Dear Mr Wiess

Reference: IAT/ME/F19/10311

Thank you for your e-mail, below.

Having reviewed the cases that you refer to, I can confirm that for all of
the 97 triages (that were closed with a decision of ‘5 year rule) for
2018, that you refer to, the Registrar had already decided that each one
was capable of amounting to an allegation that the doctor’s fitness to
practise was  impaired.

Please note, this is distinct from your query about ‘the allegations, if
proven, would amount to impairment….’  We would have no way of knowing
which of the 97, if proven, would actually have amounted to impairment;
only that each was capable of being.

I hope that this is of some help to you.

Kind regards

Mark Ellen

Dear Mr Ellen,

Please confirm how many fitness to practice concern reports have been denied an investigation by your triage team over the past year, other by reason of the 5 year rule, where the allegations, if proven, would amount to an impairment of fitness to practise.

Yours sincerely,

Mr Wiess

Thank you for your e-mail of 5 September 2019.

On the GMC website there is a Data Explorer tool which you can use to
search for a wide range of registration and fitness to practise
information. The fitness to practise information includes a comprehensive
breakdown of the outcome of all complaints over the last few years. Those
figures, together with those given in our previous responses to your
requests, provide the information you are now asking about.

Here is a link to the Data Explorer tool:

I hope that this information is helpful to you.

Kind regards

Dear General Medical Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of General Medical Council's handling of my FOI request 'Fitness to Practice Concern Reports'.

Whilst the link provided suggests a significant amount of cases have been closed at the triage stage, there is no information as to why the case was closed nor whether the respective allegations, if proven, would have amounted to an impairment of fitness to practise. As such, I do not consider my request has been fully and properly addressed.

Again, please set out how many fitness to practice concern reports have been denied an investigation by your triage team over the past year where the allegations, if proven, would amount to an impairment of fitness to practise.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/f...

Yours faithfully,

Mr Wiess
