Dear C Gordon,

Thank you for your requests for information. Apologies for the delay, the
response from the Planning Department is as follows:

We are unable to provide a list of agreements for Jan 2000 – 2011 as this
would be too onerous to answer in full and would exceed the usual
timescales thresholds under FOI. To provide evidence of expenditure would
need someone to investigate and extract invoices over an 11 year period.
Complying with this request would be too onerous and would exceed the 18
hours of officer time allocated to officers by the FOI Act under Section
12.  Therefore under Section 12 of the FOI Act as well as the
Environmental Information Regulation 12(4)(c) we are unable to provide
this information.

However, we have attached a spreadsheet containing a list of all the
agreements with repayment clauses between January 2010 and January 2020.
The relevant agreements are available to view in public access:
[1]http://www.bromley.gov.uk/planningaccess Parties named in the S106
agreements and clawback periods can be found on the agreements available
to view on public access: [2]http://www.bromley.gov.uk/planningaccess

Please note since September 2019 we now have a national requirement under
Regulation 121A of the Community Infrastructure Regulations 2010 (as
amended) to produce an ‘Annual infrastructure funding statement’ which
covers current and future CIL and S106 expenditure. Please see link to the
December 2020 Infrastructure Funding Statement, available on the Council’s
website at:
