Dear Department for Work and Pensions,

In response to the follow question from Stephen Timms MP:

“Question for Department for Work and Pensions
Social Security Benefits: Disability

To ask the Secretary of State for Work and Pensions, on what date her Department received the final report of the NatCen research project entitled The Uses of Health and Disability Benefits; and for what reason that report has not been published.
Asked 6 September 2021”

The Minister responded on 09 September 2021:

“The Government considers a broad range of analysis and evidence to support the formation of all its policy, including that which is both internally and externally commissioned. It is not necessary to publish all of this material, and the Government does not have plans to publish the NatCen report at this time.”

I believe the report in question resulted from interviews with 120 claimants about their experiences of receiving PIP, ESA and Universal Credit.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'final report of the NatCen research project entitled The Uses of Health and Disability Benefits'.

Thank you for your prompt response. It is refreshing to get a straightforward reply on time.

I note the Department's reliance on Section 35(1)(a). However, I do not believe that this stands scrutiny as the gap between the completion of the report and my request allows ample time for policy matters to be resolved. This in turn greatly reduces and public interest arguments that the Department may have.

The public interest in disclosure of this report given the severity of the ongoing problems that people experience with the social security system (e.g. suicide, 'survival sex', reliance on food banks an so on) is overwhelmingly in favour of disclosure. It would make a nice change if the Department didn't follow its normal route of wasting large sums of public money by refusing disclosure and forcing the matter to go to the ICO and then the Tribunal Service.

Complaint submitted to the ICO on 05/12/2021 to challenge the refusal to disclosure by the DWP.

Given the importance of this case I have asked the ICO to expedite my complaint to avoid the current 12 month wait for a case officer to be assigned.

The ICO notified me today that it has agreed to my request to expedite my complaint. This means that a case officer will be assigned no later than 30 January 2022.
