FHFT Bank Accounts Information

We're waiting for RASD to read recent responses and update the status.

Dear Frimley Health NHS Foundation Trust,

Can you please provide me with the following data under the Freedom Of Information Act for FHFT in respect of the Bank Accounts and the Banking Organisations that FHFT use:

1. The name or names of the Bank(s) that FHFT bank with?
2. The sort code or codes for the Bank(s) that FHFT bank with?
3. The Account or accounts numbers for FHFT with the above bank or banks
4. In the event that FHFT have multiple accounts with multiple bankers, can you please provide each set of Bank name, sort code and account number for each bank account that FHFT hold and please confirm within that which FHFT cost centre each bank account is aligned to

Dear Frimley Health NHS Foundation Trust,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Frimley Health NHS Foundation Trust's handling of my FOI request 'FHFT Bank Accounts Information'.

I am of the opinion that the excuse provided by FHFT for refusing to provide the data/ information requested is spurious and in my further view should not be exempt on the grounds stated and therefore I still require the bank details for good and legitimate reason.

Thank you for your published internal review statement.

From what you say, it appears that your main concern is publishing the data for broader public view is your concern and your view that such may result in the potential to compromise FHFT.

To overcome your concerns, I trust you will concur that this can be easily overcome by your agreeing to provide the same data sought, under this FOI, to me directly. If I agree to provide you directly with an email address through which I can receive the data in full, are you then willing to send me all the data requested in the FOI request by immediate email return? If so, can you please provide your direct email address by return so that I may connect with you directly.

For your information, the same data under a FOI request has been requested directly from FHFT who, some considerable period ago, previously declined to provide the said data against an excuse along the lines of "we don't provide this data to patients"; I trust you will concur that such is an invalid and arguably a discriminatory excuse for FHFT representative(s) deciding to decline a perfectly legitimate FOI request is unacceptable practice and in breach of the requisite Acts?

As you will be aware, placing the requestor in the current position where the only recourse is to draw in the ICO is likely to result in (a) a significant several months further delay for the requestor to receive the data from FHFT and (b) frankly in my view be a complete waste of the extremely scarce, availability-wise, resources at the ICO where I understand there is a significant waiting period for investigators availability.

If FHFT is unable to find a method FHFT feels comfortable with for disclosing the said data against the FOI requests, now requested via two distinct and separate routes, then I trust FHFT won't mind me forming the view that a further rejection to provide the said data by FHFT now not finding a mutually acceptable method for FHFT to disclose this data to me could arguably be reasonably further viewed by me as FHFT potentially seeking to use potential loopholes in the system to try delay matters as long as possible and in my opinion thereby cause the requestor the maximum delay and inconvenience?

Either way, can you please let me know how FHFT can ensure the data sought can be in my possession within 7 calendar days from the date of this resply.

Thank you for your email. You have requested information from the Trust under FOI, and I am of the view that a valid exemption for the release of this data has been provided. Additionally, this decision has been upheld by an internal review into your request. The Trust has no legal obligation to provide the data to you via another other route. As you have rightly stated, if you remain unhappy with the decision of the Trust, you have the right to appeal to the Information Commissioner Officer. In order to investigate the response you received, please can you provide the date of the response and the person who provided the response.

The Trust ensures that all requests received are processed in accordance with Freedom of Information Act 2000, and I do not agree that the application of an exemption to requested information is in any way the Trust seeking to delay matters, or to cause delay or inconvenience.
