Dear Ms Jones,

 

We refer to your request under the Freedom of Information Act 2000 (“the
Act”), made on 30^th November 2018, for the following information:

 

“1) Please provide number of complaints made to the FCA by a private
individual/member of public/not a consumer, reporting/complaining the
unregulated activities of a Regulated Financial Institution since November
2016.

 

2) Since November 2016, please breakdown/provide number of those
reports/complaints:

                   a) FCA forwarded to: NCA, SFO, NFIB, ICO, other
agencies

                   b) FCA actioned/investigated

                   c) FCA did not action/investigate”

 

Before considering your request, we would like to inform you that the FCA
as an organisation does not process general complaints unless they are
complaints directly against the FCA and which meet the requirements of the
FCA’s complaints scheme, “Complaints against the regulators”. We would
therefore refer any complainant or enquirer who expresses dissatisfaction
in relation to firms or individuals within the financial services sector
to the Financial Ombudsman Service. You may find it helpful to visit the

However, those instances when consumers call into our Customer Contact
Centre would still be logged on our systems as a contact record.

 

Turning to your request, please accept our apology for contacting you at
this late stage, but we regret to inform you that for the reasons outlined
below we are having difficulty in processing your request.

 

To help us to process your request, please clarify the following:

 

o What are you referring to when you ask for complaints from “not a
consumer”?
o What specific unregulated activities are you requesting information
about?
o Are you asking for information in relation to a specific firm or
regulated financial institutions in general?
o What are you referring to when you mention “reports/complaints” and
“reporting/complaining”?

 

Please note that under guidance issued by the Ministry of Justice and the
Information Commissioner's Office entitled "Freedom of Information &
Environmental Information Regulations - Hints for practitioners handling
FOI/EIR requests", the following advice has been given with regard to the
clarification of requests:

 

"The day after the clarification is received by the public authority the
20 working day period begins" (page 14).

The 20 working day period will commence once we have received sufficient
clarification to allow us to deal with your request.

 

If we do not receive a response within two months of this email we shall
