Thank you for your request for information under the Freedom of
Information Act 2000 (the Act) for information regarding notifications
made to the FCA in accordance with SUP 15.3.1. Your full request is set
out in Annex A.

 

Section 8(1) of the Act stipulates that a request for information must:

 

 a. be in writing;
 b. state the name of the requester and provide an address for
correspondence; and
 c. describe the information being requested.

 

While you have made a request in writing and provided an email address for
correspondence and described the information requested, you have not
provided your full name. The Information Commissioner’s guidance to
organisations states “For a request to be valid, the requester must
provide enough of their real name to give anyone reading that request a
reasonable indication of their identity. Any variation of the requester’s
title or first name combined with their surname (e.g. Mr Smith or John
Smith) will be sufficient to meet this requirement. However, a first name
or surname provided in isolation, or a set of initials, will not”.

 

Further, the Information Commissioner’s guidance states “If the requester
has used a pseudonym then their request will be invalid”. As you have
provided a pseudonym your request is not valid.

 

Should you wish to proceed with your request please let us have your full
name so we can proceed with your request. The 20 working day period will
therefore commence once we have received sufficient clarification to allow
us to deal with your request.

Your request has now been considered and we have outlined our response in
Annex A attached.

 

Please note; we have been able to collate the information you have
requested for SUP 15.3.1 and SUP 15.3.17 breaches only, but we do not have
evidence of a breach against SUP 15.3.19 from November 2018 to present.

 

 

We are unable to go back before November 2018 as the FCA only recently
updated its system to allow us to categorise records and capture SUP 15
breaches from November 2018 onwards in a specific data table.

 

You will note that some notifications in the data are listed as before
November 2018 and this is because the data field was retrospectively
updated in some ongoing cases.

Therefore, the data provides information on the records classified as Sup
15.3 since November 2018 and not the total number of notifications
received in the period you asked for.

 

We would have received more SUP notifications in the timescales provided
but we are unable to extract specific data on how many. Further, we do not
capture breaches to the level of the (1) - (4) categories as requested and
therefore we cannot provide further information.

 

We believe this should satisfy your request, however, if you are unhappy
with the decision made in relation to your request, you have the right to
request an internal review. If you wish to exercise this right you should
contact us within 40 working days of the date of this response.
