Farepak/Kleeneze/EHR Grants

Dear Department for Business, Innovation and Skills,

As your branch (CIB)has investigated the Farepak/European Home Retail Plc fiasco I am in no doubt you are very familiar with the companies I have mentioned.

I have been told the company received a government grant and now I am seeking clarification of this.

Therefore, I am looking for confirmation of the grant(s) allocated and it's monetary amount.

I would like confirmation of what company was paid a grant - European Home Retail Plc Group or it's former names in previous years - Kleeneze Plc/Farepak Plc. This would include any grants paid to it's subsidiary companies - Farepak Mail Order Ltd, Farepak Ltd or Farepak Food and Gifts Ltd etc.

These grants would have come within the remit of your former department the DTI. Therefore any section within this department that was responsible for grant allocations I am requesting this information from.

I am requesting the individual year a grant was paid. This could mean they received more than one grant.

Information to be included is as follows: -

1) The Group or company within the group the grant(s) were paid to.
2) The monetary amount (stated individually)
3) The specific date of the individual grant paid.
4)... and the total amount of grants given to the group (including subsidiaries)as a whole over the full time period stated below.
5) I'm looking for you to go back as far as 1996/97.

Thank you for your email of 26 September, forwarded to The Insolvency
Service from BIS.

 

The information you have requested is exempt information by virtue of s44
of the Freedom of Information Act 2000 and is therefore refused.

 

Section 44 states:

 

44 Prohibitions on disclosure.E+W+S+N.I.

(1)Information is exempt information if its disclosure (otherwise than
under this Act) by the public authority holding it—

(a)is prohibited by or under any enactment,

(b)is incompatible with any [[1]F19EU] obligation, or

(c)would constitute or be punishable as a contempt of court.

(2)The duty to confirm or deny does not arise if the confirmation or
denial that would have to be given to comply with section 1(1)(a) would
(apart from this Act) fall within any of paragraphs (a) to (c) of
subsection (1).

 

The enactment prohibiting this disclosure is Part XIV Companies Act 1985.

 

Specifically s449 states:

 

Such information must not be disclosed unless the disclosure—

(a)is made to a person specified in Schedule 15C, or

(b)is of a description specified in Schedule 15D.

Dear FOI,

Under no circumstances was I asking my request to be forwarded to the Insolvency Service. I know only too well they can not release the information from the company perspective.

However, my request is for BIS as a grant provider and the relevant department this would concern. Please re-submit the request but this must NOT go to the Insolvency Service.
