I refer to your recent email dated 3^rd September 2019 requesting the
following information under the Freedom of Information Act 2000 (“FOIA”):

“Can you kindly clarify the full conditions a direct family members [sic]
such as a wife or a child may qualify under Paragraph 8 of Schedule 1 as
family member of UK national that exercised his right of residence
elsewhere?”

Response

The FOIA covers requests for recorded information, rather than asking
questions or seeking explanations or clarifications, therefore your
request asking for clarification of the full conditions a direct family
member may qualify under paragraph 8 of Schedule 1 to the Education
(Student Support) Regulations 2011, as amended (the “2011 Regulations”) is
considered to fall outwith the scope of the FOIA.  

We can confirm the full conditions of paragraph 8 of Schedule 1 to the
2011 Regulations are publicly available (links previously provided in our
first email dated 2^nd September 2019) and policy guidance on paragraph 8
 can be found in the Assessing Eligibility Guidance Chapter (link
previously provided in our second email dated 2^nd September 2019).  

As you have made reference to direct family members of a UK national who
has exercised their right of residence elsewhere and how the family
members might qualify under paragraph 8, please note that eligibility
under paragraph 8 only applies to the individual applying for student
finance where that individual was settled in the UK and who has exercised
their right of residency in the EEA and Switzerland – it does not extend
to the individual’s family members if it is the family member who is the
student finance applicant and they are not settled in the UK in their own
right.  

Over and above the information included in this response, the 2011
Regulations and the Assessing Eligibility Guidance Chapter, for
clarification on this specific provision of the 2011 Regulations we would
direct you to the Department for Education (“DfE”), as the relevant policy
