Than you for your reply. The information was very useful, just not what I was after, which is details of all meetings between Sovereign Housing and West Berkshire Council relating to a proposed development at The Priory/Platt Court in Hungerford.

However if any joint consultations undertaken by Sovereign & West Berkshire Council with third parties (residents,town council etc) have taken place then I would expect these to be included in the list, together with the details requested.

Dear Sue Broughton,

1 Thankyou for the information supplied. It is clear both from your answer as well as the documents that accompany the recently adopted Housing Strategy 2010-15, and planning application 10/01928/FULEXT, that the Council has been working in partnership with Sovereign Housing on this project.
I would however still like answers to my specific questions, and if the Council has kept proper records as I believe it is obliged to do, you should be able to answer them within the 'appropriate time limits' of the FOI Act. You might be able to meet my request by providing a link to the minutes of the West Berkshire Partnership Housing Committee, which I was unaware of when I formed the request. I presume these are in the public domain? I take your point that there will have been numerous other opportunities for general discussions on the subject and am happy for you to exclude these from the scope of the request.
I would also like to receive a copy of the report presented to and approved by the Executive Committee on 22nd July which was 'exempted' at that time under Paragraph 6 – Information relating to proposed action to be taken by the Local Authority. The 'action' has now been taken, so surely the report is no longer exempt. I do not accept your justification for withholding this information and if you still feel you cannot supply it, then I will ask for an internal review.

3. Your answer to this question calls in to question the conduct of Planning Officers. Whilst the Council's own code of conduct regarding planning matters places more emphasis on Councillors keeping records of any pre-application discussions to avoid any suspicion of pre-determination or bias, I am assuming that the same rules apply to officers. I also understand that if the planning officers concerned are members of the RTPI they are bound by its code of conduct, and if any member is aware of breaches by another member they are obliged to report them. There should be a record, even if it is handwritten of all pre-application discussions, the date they took place and who was party to them. At this stage I am prepared to restrict my request to the dates of and people party to the discussions, and hope that you will be able to provide this information. If not I will seek an internal review.

This further information seems to contradict your earlier reply where you say:-

'There have been a number of informal pre-application meetings with Sovereign over the past two years. I have confirmed no collated list of dates is held. These meetings are not minuted, and attendance will have varied, but will include representatives from Planning and from Sovereign Housing. The meetings deal with the planning process, queries and forwardplanning, and with issues related to commercial processes. There is no formal record of these meetings (this is common with all pre-application meetings). It is the view of this authority that the information which is held in respect of these meetings (some emails) is commercially sensitive and also confidential'

I have already asked for an internal review of your responses and ask that this latest response be taken into account as it reinforces my view that you/West Berkshire Council are withholding information. The single planning meeting that you refer to is detailed in Sovereign Housing's application 10/01928/FULEXT which was lodged at the end of July, but not made publicly available until early September. You have made no reference to it in earlier responses to my questions.

The onus is on Public Bodies to respond promptly to FOI requests. The time limits set are 'no later' than, and I don't believe they are intended to be used for the purposes that you are using them.

WBC have already provided the report (see above)and it makes very interesting reading! There can be little doubt that the outcome of the planning application was predetermined!
