Dear Sean Brawley,

 

We can confirm that the Department holds information falling within the
terms of your request. However, we need more time to consider your
request.

 

The Freedom of Information Act 2000 (‘the Act’) obliges us to respond to
requests promptly and in any case not later than 20 working days after
receiving your request. However, when a ‘qualified’ exemption applies to
the information and an accompanying public interest test is engaged,
section 10(3) of the Act allows the time for response to be extended, in
which case a full response must be provided within such time as is
reasonable in all circumstances.

 

The Department has not yet reached a decision on the balance of the public
interest. Due to the need to consider, in all the circumstances of the
case, where the balance of the public interest lies in relation to the
information that you have requested, the Department will not be able to
respond to your request in full within 20 working days. 

 

We hope to let you have a response by 24 December.

Dear DIT FOI team,

I note you have provided data from May 2018, for which I am grateful.

However, the fact that data for my request from the period prior to this was not already collated centrally is not in and of itself an exemption. Please provide either data for the full period requested or provide the reason why you believe you are exempt from doing so. The number of cases is, judging from the numbers given since May 18, likely to be around 50 so it should be within the departments capacity to collate this data.

I am writing to request an internal review of Department for International Trade's handling of my FOI request 'Export Control Joint Unit', FOI reference number FOI2018/05644.

The response provides data from May 2018 onwards. Data for the previous outlined time period

While the data may not be held centrally, it necessarily ran through the unit and is available to the unit even if it has not yet been collated. The unit will have the relevant data, necessarily , as it undertook the work. That is has not already been centrally gathered is not in and of itself any exemption or grounds for refusal. As such, please either provide this data or provide the exemption under which the data will be refused.

The response as give does neither and is as such incomplete.
