I have been advised that the delay was due to the pressure of other work on the FOI team.

I am very sorry I have been unable to progress this matter (along with several reviews for other members of the public) due to the volume of Covid-19 related work. The approach I am taking on the other outstanding cases that I have is to review the position every 3 weeks. If I am able to deal with the matter by then I will do so, otherwise I provide an update to the requester and diarise another review for a further 3 weeks. Would this approach be acceptable to you?

At present it is difficult to judge when things will return to 'normal'.

As three weeks have passed since your last email I would be grateful for an update.
I appreciate the circumstances at the moment but as this was a single document, which I presume is available electronically, I don't quite understand the delay. Even if it exists in paper form only, the original date for a response was 6th March, some three weeks before the measures relating to the pandemic may have hampered access to documents.
I also note that Ms Linda Rees Jones provided me with a detailed response to a non-FOI, unrelated query last week so I must assume a substantive response to my request is now perfectly possible.

However, in the meantime could you kindly, and preferably quickly, just clarify one thing which I don’t fully understand; in your second point concerning the redacted information, was the other ‘identifiable living individual’ asked whether he consented to disclosure and refused to give consent, or did you make the decision to redact this information by yourself?

Gadawodd caebrwyn anodiad ()

This report, which was heavily and unnecessarily redacted was leaked to the press by the council shortly after the meeting in 2016. The first I heard about the decisions made about myself was a phone call from a local reporter. I was never given a copy of the report, hence this request. For the avoidance of doubt the redacted name of the other individual is Mark James, the now retired Chief Executive of Carmarthenshire County Council. His taxpayer funded counterclaim was deemed unlawful in 2014. His home was raided by the police in July 2019 in relation to a fraud and bribery investigation, that investigation continues.
I fail to understand why, after four and a half years, that the legal advice in this report has been redacted. My only conclusion is that it may have given me a legal advantage in my ongoing fight for justice.

I have now contacted the ICO regarding the redactions, I daresay this will take some time.

I write with regard to your complaint to the Information Commissioner in
respect of this matter which was received from the ICO on the 10^th
November.

In light of your complaint the content of the report you have requested
has been compared to information published by the Council  to ascertain
if, as you suggest it’s contents are already in the public domain.  We are
satisfied that the content of the report has not been published by the
Council in another document or another form.

Your complaint however states that the Council ‘leaked’ the report at the
time it was considered. We can find no evidence that this was the case.
Please can you confirm when precisely it was ‘leaked’ and to whom. If the
report (or its contents) have already appeared in the public domain, then
please confirm where and when.

 

The decision to redact some of the report in response to your request will
then be revisited in light of the information that you provide.
