In what way do the commission feel that ex-police members add to the objectivity or neutrality of investigations into the police who may or may not feel sentimental about the force, specifically the force they have worked in previously ?

Do the commission or does the commission have plans to have civil investigations put to a civil tier of fact, deliberated by the public at random selection ? If so why so if not why not ?

Dear Sheena Thakrar,

I ask the following questions under HM Freedom of Information (Scotland) Act of 2002:

In what way do the commission feel that ex-police members add to the objectivity or neutrality of investigations into the police who may or may not feel sentimental about the force, specifically the force they have worked in previously ?

Do the commission or does the commission have plans to have civil investigations put to a civil tier of fact, deliberated by the public at random selection ? If so why so if not why not ?

Dear Sheena Thakrar,

!FOI Requests,

Our Ref: 1003900
Your Ref:

Dear Sir or Madam,

Thank you for your request for information, received in this office on 16 September 2013.

After considering your email, I have decided that the first part is not a request for information under the Freedom of Information (FOI) Act 2000. Instead, you request the opinions on the position of the Commission.

I am therefore happy to provide you with what information I can:

On the employment of former police officers, I would refer you to the

I would refer you to look at the Home Affairs Select Committee reports on the IPCC, which includes the IPCC's responses and written evidence on employing former police officers. This also sets the work we are doing to train our own staff and recruit trainee staff in the Investigations directorate. This can be found at http://www.publications.parliament.uk/pa... (please search for ‘a second home for police officers’ in the left hand column, about three quarters of the way down the page).

Turning to your second question, which I am dealing with as a FOI request, I can confirm that we hold no records relevant to your request and that therefore there is no such plan. It may be helpful if I refer you again to the document above, and specifically to section ‘the basis for mistrust’.

As we are not dealing with your first question under the FOI Act, there is no formal right to ask for an internal review. You may therefore wish to raise any concerns that you have about FOI aspects of the handling of your request directly with the Information Commissioner’s Office, which can be contacted at www.ico.org.uk.

Turning to your second question, as this is being treated as a FOI request, you retain a right to an internal review.

If you have any queries or concerns about this letter please do not hesitate to contact me. Please remember to quote the reference number above in any future communications about this request.

If you are not satisfied with this response you may request an independent internal review by our FOI appeals officer, who has had no involvement in dealing with your request. If you wish to complain about any aspect of this decision, please contact:
