Sheena Thakrar,

Ref 1004113

Dear Jamie

Re: Request for Information

Thank you for your email at the IPCC on 20th October 13, regarding your request for information.

I note you have requested the following:

1) How many people have the IPCC had arrested for Harassment of others since January 1st 2010 for trying to report a crime to the IPCC?.

2) What percentage of the IPCC workforce/Staff are EX-Police Officers?.

3) Do any of these ex-police officers have a criminal record?.

4) Do any of the ex-police officers have any complaints raised against them during there employment as Police Officers in active duty and how many?

I can confirm the IPCC holds some of the information that you have requested. Please find enclosed the information you have requested.

1. Your request does not relate to the work or role of the IPCC. Your question relates to arresting people for harassment and reporting crimes. These are functions that fall within the remit of the police. The IPCC does not 'have people arrested' nor are we the appropriate organisation to report crimes to. It seems likely that the information you are seeking will be held by the relevant police force. Contact details for police forces can be accessed via this link: http://www.police.uk/contact/force-websi...

It may be helpful if I explain more about the role of the IPCC. The IPCC oversees the police complaints system in England and Wales and sets the standards by which the police should handle complaints about the conduct of officers and staff. We are independent, making decisions entirely independently of the police and government. We are not part of the police. Police forces deal with the majority of complaints against police officers and police staff. The IPCC considers appeals from people who are dissatisfied with the way a police force has dealt with their complaint. Since November 2012 the responsibility for determining appeals is shared with local police forces. We also may decide to independently investigate or oversee the investigation of the most sensitive and serious complaints and conduct matters that are referred to us. It is important to note that the IPCC does not have any control over the police handling of a criminal matter; we cannot instruct the police to investigate a criminal allegation nor can we review the results of the same.

2. 14 per cent of the IPCC workforce are ex police officers.

3. The IPCC does not routinely hold details of the criminal records of its staff. The information is declared by staff as part of the basic security check, however once all security checks are completed and confirmed, this information is no longer retained. Therefore, the IPCC does not hold this information.

4. We do not hold records of whether any of the ex police officers employed have had any complaints raised against them during their employment as Police Officers in active duty. All staff are required to go through security and reference checks and declare any conflicts of interest before starting at the IPCC. Therefore the IPCC does not hold this information.

If you have any queries or concerns about this letter please do not hesitate to contact me. Please remember to quote the reference number above in any future communications about this request.

If you are not satisfied with this response you may request an independent internal review by our FOI appeals officer, who has had no involvement in dealing with your request. If you wish to complain about any aspect of this decision, please contact:

All emails requesting a review should be sent directly to: [IPCC request email]<mailto:[IPCC request email]>

Should you remain dissatisfied after this internal review, you will have a right of complaint to the Information Commissioner; however, I should point out that under section 50(2)(a) of the Freedom of Information Act, you are normally obliged to exhaust the IPCC's own internal complaint mechanism before complaining to the Information Commissioner.

Dear Independent Police Complaints Commission,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Independent Police Complaints Commission's handling of my FOI request 'Ex police employed by IPCC'.

1)I know for fact, that issue of complaint for harassment from IPCC to police occurred in 2010. I was arrested for trying to complain about corrupt GMP and how they abused me and my rights.

2)Question answered

3) I am very concerned that you claim not to keep any details about your employees history regarding there employment as POLICE, this is unacceptable as we don't want any corrupt EX-POLICE investigating other corrupt POLICE constables. THIS is public interest INFO.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/e...

Yours faithfully,

Jamie Bennett-Smith

And to think that this is a publicly funded body, which should have exercised due probity.. yet seem more than prepared to cover-up instead? It really is disgraceful.. isn't it?

All UK police constabularies have in-house checks for criminal records, some say every 12 months, some say every 12 years, their is absolutely no continuity in the system at all... You could say the UK is not under common law. Getting back to the FOI request one may ask do they have Disclosure and Barring Service (CRB) checks? How often are they checked ? Who don't they employ ?
