Dear North Ayrshire Council,

I notice that Longbar ave. is for sale, Longbar near Kilbirnie. I presume this estate will
be sold to the private sector. I want to know how property which belongs to the public
can be sold off by a body of public servants who have been put in place by the public to
run public affairs have the right to get rid of our estates????

We have now completed our research for the information and the responses
to your questions are listed below.

This information is classified as exempt information under Section 25 of
the Freedom of Information (Scotland) Act 2002 on the basis that the

Marketing is at an early stage so there is currently no indication who
will buy the land.

The Council's Standing Orders, as approved at a full meeting of the North
Ayrshire Council on 11th May 2017, provide authority for the disposal of
land and property.

42. Disposal of Interest in Land and Building

The Policy for Property Acquisition and Disposal as set out in Annex B
shall

apply to the making of contracts for the disposal by the Council of its
interest

in land or buildings (including the disposal by lease thereof, other than
leases

by the Council for periods not exceeding 5 years) where the interest has
been

declared surplus to the Council�s requirements. Except in cases of
community

transfers (in accordance with the Council�s policy for the Transfer
of Assets to

the Community), or otherwise in accordance with the Disposal of Land by

Local Authorities (Scotland) Regulations 2010 where more than one offer is

received the highest satisfactory offer shall be accepted. Any disposal
for less

than the recorded value must fulfil the requirements of the Disposal of
Land by

Local Authorities (Scotland) Regulations 2010.

Annex B, as referred to above, is attached.

I have read your reply which can only be described as drivel. The estate in question belongs to the public and their consent must be sought before any man or woman, employed by the public as public servants can sell anything which is in the public domain.
