Dear Department for Work and Pensions,
I am writing to request the department position on age discrimination and the lower minimum wage for under 18s, of £4.35 accordingly.
Direct Age discrimination is described in law as to when you’re treated less favourably because of a protected characteristic, age being one of the protected characteristics.
If a 17-year-old is doing the same work, job and hours as a 21-year-old, under the Equalities act paying the 17-year-old less is age discrimination; however, the minimum wage for a 17-year-old is less than that of a 21-year-old.
With this in mind, my question is as follows:
Which law takes precedence when it comes to pay. Is the hypothetical 17-year-old in question entitled to the same hourly rate as the 21-year-old for doing the same job, or not?
And if not, how does the Equalities Act justify this age bases discrimination.
