Thank you for your reply.

I had a look through the link you sent and was unable to find the section regarding time limits between FOI's. Can you please reference the section you are talking about?

As you will be aware, I send FOI's on behalf of individuals in a group. These are therefore separate individual questions that I have acted on their behalf. You have denied FOI's in the past stating it would cost more than £450 to provide me with information that you already hold. You advised me at the time to send the questions separately. The guidance from you is therefore very conflicting, however, it could very well be my disability from the brain damage that's preventing me from understanding. I was hoping you could perhaps clarify how exactly you prefer them to be submitted and within what timeframes?

Please pass this on to the person who conducts Freedom of Information reviews. I am writing to request an internal review of Belfast Health and Social Care Trust (Northern Ireland)'s handling of my FOI requests. The response is less than satisfactory. I've outlined the concerns below.

FOI/1 Epidural Blood Patch

a) How many patients had an epidural blood patch performed by Dr Michael Watt?
b) Please provide a month by month, year by year breakdown.

RESPONSE: To undertake this exercise would necessitate a manual trawl of records. We estimate that compliance with this request for information would exceed the appropriate costs limit. Under Section 12 of the Freedom of Information 2000, the limit has been specified as £450 and represents the estimated cost of one or more persons spending 18 hours in determining whether we hold the information, locating, retrieving and extracting this information.

Complaint: Please can you provide a full breakdown of how this task would take more than 18 hours/£450? This information has already been collated in multiple forms. There is a blood patch database, an expert review of blood patches, and an internal review of 200 blood patch cases.
In addition, in this same FOI you have supplied a month-by-month breakdown of other neurologists who performed blood patches. Can you outline how this was done if you manually need to go through each of those neurologists' cases to find the blood patches, as advised by you? I find this response to be deeply worrying, given the blood patches were what initiated the review that led to the recall of over 3000 patients.

To the best of your knowledge, how many blood patch patients performed by Dr Watt are still living?

RESPONSE: The Belfast Trust is not aware of any patients who have died as a result of having an epidural blood patch procedure.

Complaint: You have answered a question that wasn't asked. I did not ask the Trust's opinion on how many patients have died following a blood patch, which wouldn't be known unless there were inquests into the deaths. I'm asking, to the best of your knowledge, how many patients are still alive?

In 2017, you conducted an internal review of 200+ Epidural Blood Patch patients, whereby the expert opinion of the world's leading expert was sought who established that around 97% did not need the patch.
1. What date did this review begin?

2. How much did this review cost?

3. How much did the work of the world's leading expert cost?

4. Please provide a copy of that report, obviously after redacting personal information.

RESPONSE: The Belfast Trust did not commission one of the World’s leading experts to review the records of patients who had an epidural blood patch.

Complaint: The 200-patient case file review has been widely reported in the press. It was reported in the Belfast Telegraph and again on BBC Spotlight, where it was revealed that 97% did not need the Blood Patch. In 2017, Dr Thomas Peukert who headed the internal investigation, advised it was the world leading expert who reviewed these cases and established whether or not a blood patch was needed. Are you now saying this report doesn't exist? Are you disputing the credentials of the expert? I don't understand your answer. There were 4 questions here but you haven't answered any? Please can you answer the questions that were asked?

FOI/4 - Management Consultancy Services via Veritas - https://www.whatdotheyknow.com/request/m...

In a 2018 board meeting, it emerged the Belfast Trust had commissioned the work of management consultants: Veritas. This was due to be completed later in 2018.

1. How much did that cost?

RESPONSE: Belfast Trust paid £59,495 (exclusive of VAT) to Verita Consulting in relation to a Maintaining High Professional Standards investigation regarding Dr Michael Watt.

Complaint: Veritas are a Crisis Management Firm. "Maintaining High Professional Standards" is an HR process. Please can you clarify why an external crisis management firm, costing £60,000 of public money, would be reviewing the personal data of Dr Watt, which should be conducted by your HR department?

Can you further advise who made the decision to commission the services and why was your HR services not appropriate?

What date did you commission the services and what date was the report completed?

2. Please provide a copy of that Report.

RESPONSE: In accordance with FOI Act, we cannot fulfil your request under Section 40(2) – Personal Information Relating to a Third Party. This is deemed to be personal information about another individual. Disclosure would breach one or more of the principles of the Data Protection Act. The report contains personal information relating to the doctor, whose identity is known.

Complaint: I did not ask for any personal information. Please provide a copy of the report redacting personal information.
