Environmental findings concerning War Memorial in Faversham

Swale Borough Council did not have the information requested.

Dear Swale Borough Council,

I understand that the small group of people responsible for the current war memorial in Faversham, undertook to have the area that was to be excavated, surveyed for Scarab beetles.

As you will be aware, beetles such as the Staghorn beetle are under threat and already extinct in some parts of Europe. Certainly, stag beetle larvae were present in the ground before the volunteers were evicted. I personally saw them.

I would be most grateful if you would provide me with a copy of the Environmental Assessment results.

I write further to your request for an internal review of FOI 878.
 
Your original request received on 18 February 2019 asked:
 
I understand that the small group of people responsible for the current

A response was sent to you on the 1 March 2019 which stated:
 
This was not a Swale Borough Council managed project so the Council does
not hold a copy of this information. You will need to contact the
Faversham War Memorial Committee directly because they hold all of the
relevant information that you are asking for.
 
On 1 March 2019 you submitted your request for review stating:
 
Thank you but I understand that public money has been spent on this

Please will you obtain and send me a copy of the findings.
 
Part I of the Freedom of Information Act 2000 makes it clear that the
public is only entitled to access information that is held by the Council,
which includes information held by other organisations and authorities on
behalf of the Council.  There is no obligation for the Council to create
or obtain information from other sources in order to respond to a request.
 
With regards to your request you have already been informed that the
Council does not have in its possession a copy of the information
requested.  In addition, I can confirm that the Faversham War Memorial
Committee is not a committee of the Council and is not carrying out
functions on behalf of the Council, therefore any information they hold
does not amount to information held by the Council.  In addition, the
funding given to the Faversham War Memorial Committee by way of grants,
did not specify any requirement that a copy of the report be supplied to
the Council.
 
Having taken into account all of the facts I uphold the original decision
and confirm that the Council is unable to provide the information
requested as the information is not held.  Nor do we have the authority to
request that the information is provided to us so that it can be
disclosed.  As previously advised, should you require a copy of the
document you will have to request it directly from the Faversham War
Memorial Committee.
 
I trust this answers your request for review satisfactorily, however
should you remain dissatisfied with the information provided you should
send your complaint to the Information Commissioners Office at Wycliffe
House, Water Lane, Wilmslow, Cheshire SK9 5AF
