Enforcement of Emergency Protection Orders in association with Social Services
Dear Suffolk Police Authority,
I am requesting a full disclosure in respect of the question's listed below;
1. On how many occasions have the police force be requested to attend with members of Social Services to enforce Emergency Protection Orders?
2. On how many case's of this type of intervention, were copies of these orders signed for by parents, in receipt of the child being removed?
3. On how many occasions have these orders been executed over the last 5 years?
4. In regards to these orders;
a) How many different social workers have been involved
with the extraction of children?
b) How many times have the same social workers names
recurred in association with extraction of children
and what were the names of these Public Service
agents?
c) How many different Judges have been involved in the
granting of these orders?
d) How many times have the same Judges names recurred
in association with extraction of children and what
were the names of these Judges.
5. On how many occasions have children been removed under direction of Social Services, and what were the reasons?
6. How many times have the police been able to give evidence to assist the parents, i.e by directly challenging a social worker?
7. Why are Suffolk Police either unable or unwilling, to investigate a member of Social Services?
8. How many times have police investigations against a Social Workers been denied?
9. In child care matters are people still policed by consent?
10. Is there a special agreement between police and social workers, granting the social workers immunity from prosecution or investigation?
11. Is the Justice Ruling now standard practise in the refusal of investigation, regarding Social Workers?
12. Are any members of Suffolk police force involved in Child Protection, members of Common Purpose? If so how many?

Dear SPA SPA,
Can you please clarify what information you don't hold!Surely if there is police action, the police should have a record of it! If an Emergency Protection Order is issued through the Court, it is executed by police assisting Social Services!
Can you please explain, just at what point should that not be available as a police record? After all if the police are involved, will they not be called to give evidence?
I suggest a look deeper into files marked "Top Secret, Social Work File" would maybe show some light on the subject, alternatively please direct these questions to the public services that does know what its doing!

April 2010, in which you requested details of the following:
Emergency Protection Orders
Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Suffolk Constabulary may be unable to achieve
this deadline. If this is likely you will be informed and given a revised
time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you chose not to make a payment then your request will remain
unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.
We anticipate being able to provide you with information that you have
requested by 20 May 2010.

Q8 - Do you mean, that it is the Social Workers who have denied the investigation from taking place?
Q9 - If you can just clarify your question further, so we can establish exactly what you require?
Q11 - Please clarify what "justice ruling" you are referring to.

Q8. Yes, I do mean where social workers have added pressure, prevented investigation etc.
Q9. I am right in saying that the public is policed by consent? If so, is policing still under consent when involved in Child matters with Social services spurious allegations?
Q10. I thought you could help me with the "Justice Ruling", as this was mentioned in an email from Suffolk Police regarding the polices denial to investigate a social worker for Perjury! Is this a special agreement, maybe through "Common Purpose"?

I am sorry that you are not satisfied with the response that Suffolk Constabulary have provided. Prior to the instigation of an internal review, we endeavour to try and resolve any issues initially directly with the applicant.
I appreciate that the answers we have provided do not answer your enquiry sufficiently, I will make some enquiries and provide a more comprehensive reason as to why this information is simply not held by the Constabulary.
I hope this explanation will be sufficient but if not of course we will continue with the internal review.

I note your request for an internal review however, Suffolk Constabulary
aim to provide further advice and guidance where possible prior to the

explains in much more detail why this information is not held by the
Constabulary, rather held by the County Council.

Are we being told, contrary to the relevant section in CA1989 (c. 41), that a Local Authority has the sole responsibility and authority to apply for and act upon, Emergency Protection Orders? Might I suggest a reread of the relevant section and of Case Law, and realise that Suffolk Police Authority have just been caught in a bare-faced lie?
Here it is again: Section 46 CA1989 (c. 41) seats the responsibility of service of EPOs and removal of minors into emergency protection entirely and solely in the purview and oversight of the POLICE AUTHORITY within whose jurisdiction the case falls.

Section 44-46 CA1989 (c. 41) puts the responsibility of emergency child protection squarely on the shoulders of the POLICE AUTHORITY. Therefore the POLICE AUTHORITY should have copies on record of EMERGENCY PROTECTION ORDERS with the mark and/or signature of the Judge or Recorder responsible for making the Order. Since this is recorded information and concerns matters of wide public interest, it should be made available via FOI.
Or do we have to go out of Jurisdiction and file a subpoena?
