Dear Bridgend County Borough Council,

Could you kindly provide a list of vacant commercial properties in the borough identifying which are owned by the council or other public body and which are privately owned.

For the properties owned by the council or another public body, could you kindly identify if these are owned or leased.

Could the list kindly include the following: (a) 1. addresses, 2. rateable values 3. date vacated; of empty Commercial properties that are within your area, which have been vacant for longer than 3 months; and

(b) the names and addresses of the owners of those properties referred to in (a)

If this could be supplied in a csv (spreadsheet) format this would certainly be appreciated.

FREEDOM OF INFORMATION REQUEST X04-230

 

We refer to your email dated 29 May 2018 which contained a request for
information as set out in italics below. Following consideration of your
request, in accordance with the Freedom of Information Act 2000, I respond
to each point as follows:

 

Could you kindly provide a list of vacant commercial properties in the
borough identifying which are owned by the council or other public body
and which are privately owned.

 

For the properties owned by the council or another public body, could you
kindly identify if these are owned or leased.

 

Could the list kindly include the following: (a) 1. addresses, 2. rateable
values 3. date vacated; of empty Commercial properties that are within
your area, which have been vacant for longer than 3 months; and

 

(b) the names and addresses of the owners of those properties referred to
in (a)

 

Whilst we hold the requested information, we consider that it is exempt
under section 31 of the Freedom of Information Act 2000 which states:

 

31. Law Enforcement

 

(1)  Information which is not exempt information by virtue of section 30
is exempt information if its disclosure under this Act would, or would be
likely to, prejudice -

(a)  The prevention or detection of crime.

As the exemption under section 31(a) is a qualified exemption it is
subject to a public interest test.

 

The Authority has identified the following factors in favour of
disclosure:

 

·         Disclosure is in the public interest as it is likely to assist
in bringing empty properties back into use.

·         There is a presumption in favour of disclosure under the Act.

The Authority has identified the following factors in favour of
maintaining the exemption:

 

·         Empty properties may be the target of theft of property,
criminal damage or arson and disclosure may lead to more crime being
committed or going undetected.

·         Maintaining the exemption would protect the public purse from
the financial impact of criminal activity.

·         Maintaining the exemption is therefore in the public interest as
it benefits taxpayers on the whole.

 

The impact of crime on individuals as an inherent part of the public
interest in this circumstance is a significant factor and therefore in our
view leads to the exemption outweighing the public interest in disclosure.

 

This is therefore a refusal notice under section 17 of the Freedom of
Information Act 2000 as we have not provided the requested information.

 

If you are dissatisfied with the handling of the request, under the
Freedom of Information Act 2000 you have the right to request a review of
the Council’s response to your request for information. If you wish to
