Empty buildings
Dear Office of the Accountant in Bankruptcy,
Can you provide me with the following information under the
Freedom Of Information Act 2000:-
(a) addresses of any empty buildings (be it commercial or
residential or industrial or industrial or storage facility etc) which belongs to yourselves
(b) addresses of any buildings (be it commercial or residential or industrial or storage or medical facility) which belongs to yourselves, that are scheduled to be vacant in the next 12 months for whatever reason.
(c) if possible, type of use (eg. storage, office, warehouse, training, staff accommodation, medical facility etc) of those buildings referred to in (a) and (b)
(d) if possible, approximate date (month and year) from which it became empty or will become empty, of those buildings referred to in (a) and (b)

Thank you for your request for information under the terms of the Freedom of Information (Scotland) Act 2002.
The Accountant in Bankruptcy is based in a rented property in Kilwinning and does not own any estate. The Accountant, however, has a statutory role to act as trustee in Scottish sequestrations where a private trustee has not been nominated. Once a debtor is sequestrated, their estate is vested in the trustee from the date of sequestration. This is essentially a fiduciary process where the trustee is required to realise the estate for the benefit of the creditors in the sequestration. The estates which become vested will often contain heritable properties. As trustee, the Accountant's interest in these properties is transient and ceases once they are sold or abandoned. The role of the trustee in sequestration is prescribed by the Bankruptcy (Scotland Act) 1985 as amended.
Whilst the vested properties are not owned by the Accountant per se, I thought it important to provide the above information for the purpose of transparency. I will be pleased to provide further details on the sequestrated properties that vest in the Accountant if desired. I hope this is helpful.
