Dear General Dental Council,

I am writing to you under the Freedom of Information Act 2000 to request the following information from your HR Team:

- The number of employment tribunal cases for 2014, 2015, 2016 (to date) in which the GDC was/is a respondent, and the grounds of the claims (e.g. discrimination, etc) for each instance, and the outcomes for each case;
- If there is any current/live case, and if so, in which Employment Tribunal venue it is being heard;

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under your Section 16 obligations, as to how I can refine my request to be included in the scope of the Act.

In any case, if you can identify ways that my request could be refined please provide further advice and assistance to indicate this.

I look forward to your response within 20 working days, as stipulated by the Act.

I am writing further to your request for information which I confirm has
been considered under the Freedom of Information Act 2000 (‘the FOI Act’).
For clarity I am copying your questions below, with our response.
 

 1. The number of employment tribunal cases for 2014, 2015, 2016 (to date)
in which the GDC was/is the respondent

 
2014 – no cases
2015 – one case
2016 – one live case
 

 2. The grounds of the claims

 
The GDC holds the grounds of the claim information, however, that
information is only available to the parties to an employment tribunal
case and is exempt from disclosure under the court records exemption in
section 32(1)(b) of the FOI Act, being ‘information contained in any
document served upon, or by, a public authority for the purposes of
proceedings in a particular cause or matter’.  The exemption in section
32(1)(b) is an absolute exemption, which means that it is not subject to
the public interest balancing test.  In addition, it may be helpful to
explain that the only employment tribunal case information that forms part
of the public register of employment tribunal claims is judgments and
written reasons for judgments, provided the written reasons were not
deemed private and ordered to be omitted from the public register. 
Pleadings (i.e. claim forms and defences), witness statements and trial
bundles are not made available to the public.   
 

 3. The outcomes of each case

 
2015 – the case was settled before the hearing, therefore it was not
heard.
2016 – the case is listed to be heard on 14/11/16, therefore the outcome
is not yet known
 

 4. The employment tribunal venue for the live case
