Subject: Over £389 million of unfinished building sites left to rot in Vauxhall Liverpool, and all 3 councilors along with the Liverpool echo, refuse to explain why and how this took place.

1] Will the council please supply all records of the meeting of; Cllr Joe Hanson with Joanne Karen Waller of Blackstock Street Limited; number [11196777] what has been his involvement into this failed development in his ward [Vauxhall]?

2] Will Cllr [Hanson] explain his role into the other failed development site; The Tannery which is just 300 ft. from this new site [Blackstock St] known as; [Kingsway Square] on Blackstock St, Vauxhall Liverpool, The master new company behind this is;
[Sourced Development Group]

3] Cllr Hanson and his other two councilors were all informed about several sites all over the Vauxhall ward 3 years ago and just six months ago with regards to; Kingsway Square in Vauxhall all three stonewalled all the files and information sent to them why?

4] Will Cllr Hanson, explain his close relationship with a developer and is he working as a consultant or moonlighting, as was [Cllr Joanne Calvert] with Fox Street Village ltd while working for the council, is Cllr Joe Hanson doing the same thing?

5] The Tannery has ripped off investors and Cllr. Hanson was looking into the persons behind it, has he finished his report on this and on the Metalworks, and will his finding be made public along with his relationship with Mr. Antonio Garcia and 174 law solicitors?

6] Will the council please explain how and why the [Tannery site] is a dump site in Vauxhall and has now become a new renamed development site, has the council being made aware of this by Cllr Hanson and Cllr Kennedy?

Did the council keep all records of the complaints of investors of the Tannery and why did the Liverpool echo run this story promoting the [Tannery]?

She had told buyers the luxury flats are almost finished, then some months later admits several terribly upset investors had called her, she said she had been tricked and misled by the PR agents.
Cllr Joe Hanson was told of this and others in the council including the Mayor, both Cllr Hanson and then Emilia Bona from the Liverpool echo, went in total lockdown and when Emilia Bona was asked for the list of investors, she just put the phone down.

1.             No such records are held by the City Council and the
remainder of this question comprises comment, speculation and opinion
which are not valid requests under Freedom of Information legislation.

2.             Freedom of Information legislation relates to information
held by public authorities and does not extend to providing responses to
speculatory comments and expressions of opinion.

In relation to the comments and speculation you make relating to
individuals -

It is our assessment that the content of your statements within your
request are in whole or part potentially defamatory in nature, that these
identify or refer to individuals and are being published by yourself
through the use of a public website forum to third parties.

 

We would further advise you that the defamatory statements made by
yourself either directly or through recognised aliases and contained
within the information requests referenced above fall within the meaning
of Article 14(1)(a) of the E-Commerce Directive (2000/31/EC). Under the
law of England and Wales, a defamatory statement is one which tends to
lower the claimant in the estimation of right thinking members of society
generally (Sim v Stretch [1936] 2 All ER 1237).

 

We would further advise that a defamatory statement is published at the
place where it is read, heard or seen, and is not where the material was
first placed on the internet. In internet cases, therefore, provided a
small number of people have access to the material on the internet in
England, the English courts will have jurisdiction to hear the claim
against a foreign defendant (Spiliada Maritime Corp v Cansulex Ltd [1987]
A.C. 460).

 

We would therefore advise that you take prompt action to remove or
disabled access to the Offending Webpages.

 

In the event that this confirmation is not received, the individuals named
directly or by implication within the above referenced information
requests and publicly displayed on the Offending Websites shall reserve
the right to issue proceedings against you seeking relief for defamation.

 

The remedies that may be available to the these individuals include an
injunction restraining further publication of the Offending Statement
[pending trial], damages, legal costs and interest.

 

This concludes our response.

The City Council will consider appeals, referrals or complaints in
respect of your Freedom of Information Act 2000 and you must submit
these in writing to [1][email address] within 28
days of receiving your response. The matter will be dealt with by an
officer who was not previously involved with the response and we will look
to provide a response within 40 days.

 

If you remain dissatisfied you may also apply to the Information
Commissioner for a decision about whether the request for information has
been dealt with in accordance with the Freedom of Information Act 2000.
