Dear Airedale NHS Foundation Trust,

Could you please provide me with answers to the following questions regarding electronic patient records and data-sharing with other organisations, under the Freedom of Information Act:

1. Does your Trust use an electronic patient records system?
2. What is the name of the electronic patient records software used by your Trust?
3. Does this software permit patient data to be shared with other organisations outside your Trust? Please provide a list of the other organisations that have access to the data.
4. What procedures are in place to obtain patient consent that their data may be shared with other organisations? Please provide me with a copy of your Trust's policy for obtaining such consent.
5. Does the software allow outside data sharing without patient consent being explicitly granted? Please provide me with a copy your Trust's policy on the circumstances in which such outside data sharing without explicit consent would be permitted.
6. During 2017, on how many separate occasions and for how many individual patients, was patient data authorised to be shared with outside organisations without explicit patient consent being obtained beforehand?

Thank you for your request for information from Airedale NHS Foundation
Trust which was received on 2^nd March 2018.  Your request has been given
the Reference Number 3365 . 

 

We will now proceed to process the request.  The deadline date for issuing
you with a full response is 30^th March 2018.   We will endeavour to
respond to you in advance of this date and we will contact you if we
envisage delays or if we need more information from you.

 

Please note that under the Freedom of Information Act, some information
can be subject to exemptions, which means that the Trust does not have to
provide the information requested.  Some exemptions are “absolute” such as
personal information and some only apply where the public interest in
maintaining the exemption, outweighs that of providing the information.

 

In some cases, where identifying, retrieving and processing the requested
information requires more time than the appropriate “cost limit” of two
and half days work, we may refuse the request, or we may charge a fee.  If
the latter is the case, I will let you know and a Fees Notice will be
issued to you.  If you still wish to receive the information, you will
need to pay the fee before we proceed with your request. 

 

We will offer assistance and advise you if, by modifying your request, we
could provide you with some non-exempt or free of charge information.

Information Act (Our Ref. 3364) please find our response below.  Please
accept my apologies for our late reply.

 

1. Does your Trust use an electronic patient records system? -  Yes

2. What is the name of the electronic patient records software used by
your Trust? -  TPP SystmOne

3. Does this software permit patient data to be shared with other
organisations outside your Trust?  Please provide a list of the other
organisations that have access to the data.  – Yes, with TPP SystmOne
units/organisations .  Patients consent explicitly to their sharing of
clinical data outside of the organisation.  Explicit Consent is also
required by the recipient organisation, and access to the record is only
permissible if there is an ‘open referral’ - e.g. an outpatient referral
or emergency department attendance.

 

4. What procedures are in place to obtain patient consent that their data
may be shared with other organisations? Please provide me with a copy of
your Trust's policy for obtaining such consent. – Consent to ‘share out’
using our EPR is explicit, and recorded within the record.

 

5. Does the software allow outside data sharing without patient consent
being explicitly granted? Please provide me with a copy your Trust's
policy on the circumstances in which such outside data sharing without
explicit consent would be permitted. - The software functionality does not
allow sharing out without explicit consent.
