Dear Mr Smith

Freedom of Information (Scotland) Act 2002

The Environmental Information (Scotland) Regulations 2004

Request for Information – Electric Vehicle Charging Points

I refer to your request for information dated 30 October 2017.

The information you requested was:-

1) How many public electric vehicle (EV) charging points do you currently
have in your council area?

2) How many do you plan to have by 2020?

3) How many do you plan to have by 2032?

I consider that the information related to your request as a whole is
subject to an exemption under the Freedom of Information (Scotland) Act
2002 (FOISA). Section 39(2) of FOISA effectively exempts all environmental
information from disclosure requiring instead that it is considered under
the Environmental Information (Scotland) Regulations 2004 (EIRs).  I
consider the substance of your request to be covered by the definition of
environmental information contained in the EIRs, and have accordingly
processed your request under the EIRS.

Please click [1]here for further detailed information about how we deal
with EIRs.

Response

 1. Perth & Kinross Council has 32 EV charging units located across the
Council area. Please be advised that this does not include those
provided by third parties.

 2. We do not have a set target as the number is largely dependent on
future funding streams. In terms of regulation 10(4)(a) of the EIRs,
this is formal notice that this information is not held.

Under the terms of the EIRs we have to consider the public interest even
when we don’t hold the information you have requested. Because of this
requirement, I have to formally advise you that the public interest in
maintaining the exception outweighs the public interest in making the
information available. This is a legal exercise required by the Scottish
Information Commissioner and I apologise that this is counter intuitive.
