Dear David Smith

Subject : FOI Request

Thank you for your email dated 27/10/2017, which was received by North
Ayrshire Council on 27/10/2017, requesting information about Electrical
Vehicle Charging Points.

You have asked for information from the Council by referring to the Freedom
of Information (Scotland) Act 2002 (FOISA). I consider that the
information which you are requesting is ‘environmental’ information and
therefore the Environmental Information (Scotland) Regulations 2004 (EISR)
also apply. Both EISR and FOISA provide similar rights to access
information and place requirements on the Council to consider requests and
to provide information.

The Scottish Information Commissioner has provided some guidance on how we
should deal with requests where both FOISA and EISR apply. In line with
the Commissioner’s guidance I am applying the exemption in Section 39(2)
–and I intend to respond in line with EISR. I can confirm that the Council
will consider your request and identify any relevant records held.

North Ayrshire Council acknowledges receipt of your request and confirms
that it will respond to you within the time scales as required by the
Environmental Information (Scotland) Regulations 2004. We will contact you
if we require any further information.

Please note that in terms of Section 7 of the Regulations, the Council may
extend the timescale for dealing with complex or voluminous requests to 40
working days. We will write to you as soon as possible after the receipt
of your request to advise if this will be the case.

The information that you supplied with your information request will be
entered into a filing system and will only be accessed by North Ayrshire
Council staff. The information will be retained by North Ayrshire Council
and will only be used for the purpose of (a) processing your Request for
Information and related purposes, and (b) for statistical and audit
purposes. The information is held by North Ayrshire Council in accordance
with the provisions of the Data Protection Act 1998.

Further information on Environmental Information Regulations is available
