Dear Jenna Corderoy

FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Thank you for your request for information received on 28th January 2019.

The registration of electors is governed by the Representation of the
People Act 1983 as amended. Under Section 8 of the Act, local Councils
must appoint an Electoral Registration Officer the appointment is separate
to any other appointment by the Council and the duties are personal to
that post. The Electoral Registration Officer does not carry out the
duties on behalf of the local authority but in her own personal capacity.

As the Freedom of Information Act does not list any person appointed under
the Representation of the People Act 1983, it follows that the Electoral
Registration Officer, Returning Officer or any other person appointed
under the Act are not subject to the provisions of the Freedom of
Information Act.

However for your information I would say that under Regulations 97 – 114
of the Representation of the People Regulations 2001, as amended,
Registration Officers must provide copies of the Register to certain
prescribed bodies. The permitted use is restricted to electoral purposes
(Political Parties) crime prevention and detection (including Credit
Reference Agencies) and certain specified research purposes.
