Last year you were kind enough to answer the questions below for the years 2012/13, 13/14 and 14/15. I would be grateful if you could now bring the figures up to date by answering the same questions for the year 2015/16.

1) the number of "notices to satisfy" issued under section 437(1) of the
Education Act

2) the number of school attendance orders issued

3) The number of education supervision orders issued where the families
claimed to be home educating

4) The number of referrals made by the elective home education team to
the Child Missing Education (CME) team

5) The number of referrals made by the elective home education team to
social services

They have 48 notices to satisfy + 48 referrals to CME, but last year only 3 notices to satisfy. Do you think the answer may be confused?

Dear East Sussex County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of East Sussex County Council's handling of my FOI request 'Elective home education - actions taken 2016'.

In answer to my question asking for the number of referrals made by the EHE team to social services, you have replied: "To answer this questions would require going through all 675 home education cases individually to see if a referral had been made to social care. If this only took 5 mins per case it would still take in excess of 56 hours – far beyond the cost limit defined in the FOI Act as 18 hours. "

However, you were able to supply this information for the three previous years (along with all of the other information in the same request) without reaching the FOI cost limit. As you only have a very small number of staff in the EHE team, I contend that it would not take very long at all simply to ask each of those staff in turn how many referrals they have made. They are likely to know with a reasonable level of accuracy without reference to the files at all. Failing that, perhaps social services will have kept records of the sources of their referrals and will be able to tell you without expending much time.

Sadly, Fiona, I don't think they are confused. I had a pretty good idea from local groups that the number of notices to satisfy had shot up considerably in the last year. I just need to find out why they don't want the number of referrals to social services revealed now.

Thank you for your email. As you are dissatisfied with the response provided, I have referred your request to Legal Services to undertake an Internal Review. Your request along with the response has been sent to them to undertake this Internal Review. We are permitted up to 20 working days to carry out a review, which in complex or voluminous cases can be extended to up to 40 working days. It is your right to raise your concerns with the information Commissioner at any time but I should advise you that he is unlikely to look at your complaint until you have exhausted our internal review process.

We aim to provide our response by 6/9/2016 which is the 20 working day deadline.
