Hello. After a panel meeting x amount of parents / children / young people are told. i) we will not do a needs assessment or ii) we will not issue and ehcp.

I would like to know how many parents / children / young people are told this after each panel.

They might go on to appeal or mediate, but I am not interested in that figure.

It shows the following figures:

3. During this period how many needs assessments were carried out? The data doesn't say, which is why I made the FOI to find out an exact figure.

4. During this period how many times did BCC decide not to issue a Educational Health Care Plan following EHC Needs Assessments? Please provide the figure for the number refused at Panel 2 prior to mediation / appeal. 5

5. During this period how many EHCPs were issued? 172

6. How many were still being assessed / finished assessment but no decision was taken at the end of the year: 269

In this SEN2 data there seems to be 87 missing pupils? For example, 607 requests we made, 74 were refused at panel 1 = 533 C/YP remaining.

533 should have been assessed (but I don't know how many were assessed since you have not provided me with the data), 5 of those went on not to be issued with an EHCP (I think). = 528 C/YP remaining

172 EHCPs were issued... 528-172 = 356 C/YP remaining.

269 EHCPs were pending. 356 - 269 = 87 C/YP who possibly didn't go through a EHCNA? That is what the SEN2 data suggests. Is this correct?

Thank you for your email requesting clarification on the response you

In the SEN2 data, the number of requests should not be compared to
outcomes as they may not relate to the same year. The SEN2 provides the
total number of initial requests received in that year (2018 in this
case). Data on the numbers of plans finalised and refused at panel 1 and
panel 2 will not necessarily be from requests in the same year but instead
relate to those finalised in that year.

If you are dissatisfied with the handling of your request, you have the

On the 26^th July we clarified our response and stated:

In the SEN2 data, the number of requests should not be compared to
outcomes as they may not relate to the same year. The SEN2 provides the
total number of initial requests received in that year (2018 in this
case). Data on the numbers of plans finalised and refused at panel 1 and
panel 2 will not necessarily be from requests in the same year but instead
relate to those finalised in that year.

You responded the same day stating it was impossible to determine using
the SEN2 data and could we answer the questions as asked rather than
providing a link to data that did not answer the questions.

I requested the service again review their response and by way of
additional clarification can confirm you have accessed the correct data,
as you set out in the clarification request, sourced from the SEN2 web
pages.  

With respect to question 3, we are unable to provide data prior to 2019 as
this is before data migration and data in the system is unreliable. The
only data available for this year is that which is included in the
published SEN2. An estimate of the number of assessments carried out can
be calculated using the number of plans finalised, and the number of
assessments where it was decided not to issue an EHCP, added together.

If you had intended to ask how many EHCNA's were there and of these, what
were the various outcomes - that is a different question. If that were the
intended question, I am afraid it is not possible to take the 607 EHNA's
(EHC Needs Assessments) and then to whittle them away as they are
apportioned to different possible outcomes e.g. failed at Panel 1, or
Panel 2 etc.  The data that we hold, and publish, is how many EHCNA
requests were made that year. Separately we publish e.g. how many were
refused at Panel 1 etc.  They are not necessarily the same requests that
are referred to - it is simply a count of how many were turned down at
Panel 1 that year, or how many were turned down at Panel 2 that year.  As
such, it is not possible to use the SEN2 to provide an answer.

If we were to be asked to identify the 607 EHCNA's referred to and to work
out what happened to each of those, it would take too long to calculate. 
We would have to open each case and read each one to find out the outcome
- i.e. 607 x 10 mins on average which would take about 101 hours.  This
would exceed the time limit of 18 hours as prescribed under S12 Freedom of
Information Act and such a request could be refused in on those grounds.

The figures in your Q6 above are not correct as you can not calculate the
figures this way.  This was explained when the service clarified your
request previously.  Due to the fact that requests are recorded in the
year they are received and have a 20 week processing time, many are
completed in the subsequent year. This means that when you attempt to make
your own calculations, the numbers will not make sense as two separate
data types are being compared.

The Freedom of Information Act only provides for an authority to provide
the information it holds in recorded form.  It is not required to create
new information in order to answer a request.  Unfortunately we can
provide no better information to answer your request than that which we
have already provided.

Dear Bristol City Council,

thanks for the very detailed reply.

In your latest reponse you said, "On the same day you responded and asked 2 additional question 5 and 6
below:" I didn't ask any additional questions. Point 5 and pint 6 were not questions, they were points in relation to the data set you provided. Just to clarify.

I realize now that the data I am trying to obtain will not be available as I was not clear enough with my "During this period" statement. I was hoping there was a for eg data set that read: "600 EHCP requests sent in 2020, of those 600 x did not have a EHCNA, of those 600 x had a needs assessment, of those 600 x were not issued with an EHCP, of those 600 x EHCPs were issued and of those 600 x EHCPs are pending".

Thank you for clarifying that the data is not stored in this way and that it would take too long to dtermine.
