Please can you provide me with the name of the current educational placement (school) of any young people, 16 years of age and under, with educational health care (ehc) plans or statements, placed in independent or non-maintained provision?
Under the Freedom of Information Act 2000, I would like you to supply me with the information requested for the previous academic year - 2017/18.

I would ask you to provide the information in an excel document, broken down under the following headings:

Category of Need (SEMH, ASD, etc.)
Name of School
Type of placement - (Day or residential placement)
Cost of placement per year

Dear Lily, please accept our sincere apologies for the delay in responding to your request, I can now advise as follows:-

We believe that the information requested is exempt from disclosure, as this is considered to be personal information and is exempt from disclosure under Section 40 (2) of the Freedom of Information Act 2000. This is necessary in order to protect the rights of third parties to privacy and confidentiality. In this case, Hartlepool children and young people with EHC plans attending specialist and non-maintained provision. The numbers of young people placed in specialist provision, with EHC plans under each specific, identified category of need, in most cases will be equal to or less than five. The numbers of young people placed in each setting would also be equal to or less than five. This information would potentially identify those pupils and details of their physical or mental health, which are types of personal information specified as ‘special categories of personal data’ under the Data Protection legislation.

We consider that the absolute exemption set out in Section 40 (Personal information) subsection 2 applies to the information requested because to release it would be a breach of the Data Protection Act 2018. Personal Information is governed by the Data Protection Act 2018 (DPA) and relates to data of a living individual who can be identified from that data. The withheld information is exempt because disclosure would contravene the first data protection principle which requires that personal data is processed fairly and lawfully. Disclosure of the requested information would breach this principle and in particular the requirement of fairness because individuals have a reasonable expectation of privacy and do not expect that the council would disclose this information in response to a Freedom of Information request.

When information is disclosed under the FOIA, it is effectively disclosed to the public at large, not only to the requester. The interest in disclosure must be a public interest, and this public interest must outweigh the rights and expectations of the individuals to whom the information relates. It is a reasonable expectation on the part of Hartlepool children and their families that information that could identify them is not placed in the public domain. It is the view of the Council that to disclose this information would not be fair to these individuals and that there is not a sufficient public interest in this information to justify disclosure.

We have however, provided an average cost of day placements, along with the numbers of young people accessing.

There are 27 young people accessing day placements at an average cost of £59,124 per year (this does not include young people with an EHC in academies within the LA area)
