Dear Ms. Kerrigan

FREEDOM OF INFORMATION REQUEST REF: 2017-1463

I am responding to your request under the Freedom of Information Act 2000,
which we received on 29 September 2017, for information held by the
Council. Your request is as follows:

I write to ask you to provide me with information regarding the education
and school placements given to children under 16 years of age with Special
Educational Needs who have EHC plans/ statements.

Under the Freedom of Information Act 2000, I would like you to supply me
with the information requested for the past two school years (2015/16 and
2016/17).

I would ask you to provide the information in an excel document, broken
down under the following headings:

Academic Year (2015/16 and 2016/17)

Category of Need (BESD, ASD, etc.)

Name of School

Type of school - (Maintained/non-maintained/independent)

Type of placement - (Day or 38 week placement)

Cost of placement per year

I confirm that we hold the information requested.

We have decided to withhold the information requested because we believe
that the details requested could lead to the identification of an
individual/

Under section 40(2) of the Freedom of Information Act, we are permitted to
withhold information which, if disclosed, would breach any of the
Principles contained in the Data Protection Act 1998 (the Act). We believe
that the withheld information, alongside information already in the public
domain and local knowledge, could identify an individual which would
breach Principle 1 of the Act (fair and lawful processing).

Disclosure of this information would be unfair because the individuals in
question have a reasonable expectation that the Council would not release
information into the public domain which could identify them. If
identification occurred, this would be an unwarranted intrusion of their
privacy.

Complaints

I trust this has satisfied your request. Should you be unhappy with the
handling of your request, the Council has an internal complaints process
for handling FOIA complaints. Complaints are reviewed by the Chief
Solicitor and Monitoring Officer or her nominee. A form is available from
our website to lodge your complaint
[1]http://www.rbkc.gov.uk/councilanddemocra...
Please contact us if you do not have website access and we can provide you
with a copy of the form. Following this review, should you still be
unhappy with how your information request has been handled, you have a
further right to appeal to the Information Commissioner who is responsible
for ensuring compliance with FOIA.

Yours sincerely
