We are now in an emergency situation with regard to the COVID pandemic,
therefore, please be aware that if we are dealing with your request during
lockdown there may be severe delays. Any requests that relate to COVID we
request that you withdraw until our areas are in Tier 1.

We will make every effort and are endeavouring to respond to other
requests (that do not impact on COVID Information / Clinical areas) within
the 20 working days of receipt, due to ongoing current operational
pressures, there may still be some delays if the request relates to
certain teams that are still involved heavily in Covid-19 tasks.

will not be processed before Covid-19 movement restrictions are lifted.

I am not sure of what is your final response.

On one hand you have written that you do not collate the information; in another reply you have written that it exceeds 18 hour limit without elaborating it.

Please recheck your response. Most NHS trusts collect such data regularly

After taking a careful look at the below, we realised that we sent an email to you in error which we tried to recall immediately we noticed the error but was unsuccessful. The letter we sent in error was meant for our internal review and was not going to be our final response to you.
If you will recall an email was sent immediately to notify you of the error and to disregard it.

As per ROYAL COLLEGE OF PSYCHITARY ECTAS standards for ECT, age, ethnicity, etc are the basic data Trust needs to collect for ECT.

Dear Dr Mukherjee,

 

I write further to your email dated 13^th September 2021, in which you
requested an internal review in respect of the FOI request response you
received from the Trust (ref 21 FOI 291).

 

Having spoken to the FOI Team and also the service who provided the
response, I can update you as follows.

 

Responding to the specific nature of your FOI request – particularly the
detailed and granular information you requested – would have required the
Trust to produce information which it wouldn’t otherwise hold, as opposed
to collating data which is normally collected. That being the case, the
FOI Team responded to you to inform you that the Trust did not hold the
data you had requested. This is entirely in keeping with Freedom of
Information legislation, whereby organisations are not required to create
new data to respond to FOI requests.

 

I am aware that the service also looked to see if any of the information
you had requested was produced as part of any regularly-published reports,
such that they could be provided to you. Unfortunately I understand that
this wasn’t the case.

 

The above circumstances being the case, I am reassured that the response
you were provided was accurate.

Thank you for your email.

To clarify, the back-end data that the Trust records may contain the data items which you refer to but to produce the information in the format that you requested it would have required the service to produce brand new data, which is not how the FOI provision is supposed to be applied. While I appreciate that this is not the answer you are looking for, please be assured that the information were in a regularly-produced and readily available format, it would have been available for consideration for disclosure.

I understand that the service also endeavoured to see if the data you requested was available in report form already, so they could provide you with some response to your request. Alas, I understand that this was not the case.
