Please can I amend my request I put in this morning .

I see from your consultation document that you sent out 120000 postcards to local residents to advertise the early phase consultation in 2019. I would like a copy of the mailing list of those addresses.

I do not require the name of the person the cards was sent to as this would constitute personal data.

If the list is too long, then please reduce its size to contain street name, town, postcode.

I would also like any information you have on proof of postage and date of postage - e.g copy of franking log or invoice with cost of postage shown.

address list from our supplier. We are currently undertaking a piece of
work to sanitise and remove personal data in compliance with GDPR for all

Thank you for your patience while we compiled our response to you.

We can confirm an internal review of your Freedom of Information request
has now been undertaken by a Director who has confirmed that the original
decision is to be upheld.

Therefore, a further internal review by a different Director, who was
independent to the original decision, has also been undertaken (as would
be expected by the Information Commissioner for processing a
complaint). The results of this review also confirmed that the original
decision should be upheld.

As advised, we are undertaking a significant piece of work to cleanse and
remove personal data in compliance with GDPR for all 120,000 postcard
recipients from the 2019 non-statutory consultation. We sourced the
address list from our supplier and engaged in a lengthy activity to ensure
we could publish the requested information safely. This work has taken
significant time and resource to coordinate and the data will be available
on our website very soon.

The list of addresses as part of the 2019 consultation process were
provided in a format which included the full addresses of all postcard
recipients which meant that individuals could be identified if the
information was published in unredacted form. Therefore the work to redact
this personal data had to be performed prior to publication.

Data protection legislation makes clear that identifying location data
constitutes personal data (for example, see paragraph 3(a) Section 3 of
the Data Protection Act 2018). Note further that the ICO has published
guidance on how to interpret data protection legislation which can be

We would like to reassure you that we will have fulfilled your request for
information in the very near future, and we will let you know when it is
accessible via our website.

Dear Ms Evans, 

Thank you for your patience while the team worked to produce the
information you have requested.

We refer to your request for information on the addresses to which
postcards were sent to inform people of our 2019 non-statutory
consultation. The attached document provides a summary for each postcode
district and sector as well as the full list of addresses.

We have handled your request in accordance with the Freedom of Information
Act 2000 (FOIA). Whilst FOIA section 1 provides a general right for the
public to request information held by public bodies, this right is not
absolute and is subject to a number of exemptions. For example, FOIA
section 40 provides an exemption from the right to information if it is
personal data as defined in the Data Protection Act 2018. Accordingly, we
have made some redactions to the information which are described in more
detail in the attached document.

In addition, FOIA section 14 has the effect of disapplying the citizen’s
right to be provided with information under FOIA section 1 if this would
impose a disproportionate burden on the public authority in question. The
purpose of section 14 is to protect the resources (in the broadest sense
of that word) of the public authority. 

In preparing this information for publication, we have been required to
devote a significant amount of resources and staff time to collating,
redacting and checking each individual item in the dataset. We estimate
that this work has taken over 36 hours to complete given the sheer volume
of information in question and it has entailed a significant cost to the
public purse.

We consider that the exemption in FOIA section 14 would have been engaged
in this case and would have permitted us to refuse to comply with your
request. Nevertheless, given the level of public interest, we have
prepared the information for general publication and it is also available
on our website. 

As you will be aware the second [1]non-statutory consultation is currently
open and we look forward to receiving feedback from you, as well as
continuing our engagement with you as the railway progresses into the next
stages of design.
