DVLA giving out an individuals personal data to parking companies

Response to this request is long overdue. By law, under all circumstances, Driver and Vehicle Licensing Agency should have responded by now (details). You can complain by requesting an internal review.

Dear Driver and Vehicle Licensing Agency,

DVLA gave my personal data to a private company. This company says in its literature that it will share information with "Analytics organisations".

Please supply me with the following information.

1. Who gave my personal information to this company.

2. Was DVLA paid for the information.

3. I want DVLA to provide me with its "complaints procedure"

4. I want the name and address of the CEO of DVLA.

5. I want DVLA to get my personal information back from the company you sold it to.

Further to this : -

Please Furnish me with the the following information : -

- the DVLA's definition of the 'reasonable cause' that must be demonstrated by a private company before they will have data provided to them

- the DVLA's definition of 'fair enforcement' as it pertains to the private parking industry

- the DVLA processes and procedures for assessing whether the private company has demonstrated 'reasonable cause' to have data, in each individual request

- the number of staff employed by the DVLA in assessing whether private companies have demonstrated this 'reasonable cause'.

- the DVLA processes and procedures used to 'carefully evaluate' every individual request for information

- the number of staff employed by the DVLA in the process of carefully evaluating every request for information

The DVLA allows private parking companies to access vehicle keeper records by the electronic KADOE service.

The Road Vehicles (Registration and Licensing) Regulations 2002

Disclosure of registration and licensing particulars
27.—(1) The Secretary of State may make any particulars contained in the register available for use—

(a)by a local authority for any purpose connected with the investigation of an offence or of a decriminalised parking contravention;
(b)by a chief officer of police;
(c)by a member of the Police Service of Northern Ireland;
(d)by an officer of Customs and Excise in Northern Ireland; or
(e)by any person who can show to the satisfaction of the Secretary of State that he has reasonable cause for wanting the particulars to be made available to him.

They are supposed to check each request but dont bother.

I don't have to tell you the name of the company because you lot gave my data to this company. You should know who you age my data too.

The name of the company is "Civil Enforcement Ltd".

You do not give anymore information out to this company about me especially this FOI request to you.

You DO NOT tell them I have been in contact with you at all.

Never again give any of my data/information to any organisation other than the police.

That is on its literature to me.

Now stop being obtuse and get on with it.

If you carry on like this anymore I will lodge a formal complaint against you Mr Ian Davies and I will be writing to my MP and the Information Commissioner.

I believe the DVLA have breached the GDPR in this case.
The Road Vehicles (Registration and Licensing) Regulations 2002 s28. The Secretary of State may sell information derived from particulars contained in the register—
(a)to such persons as the Secretary of State thinks fit;
(b)for such price and on such other terms, and subject to such restrictions, as the Secretary of State thinks fit,
if the information does not identify any person or contain anything enabling any person to be identified.
These last 2 lines are the important ones.The information that the company were given DID identify the man.
